Day 4: Hearing Resumes

This morning, Senators will question Judge Alito during a third round. They will then go into a closed session, to review the FBI background investigation on the Supreme Court nominee. Outside witnesses may be called to testify this afternoon, as well as the American Bar Association, to discuss its recommendations.

You are correct. However, the USSC gets involved because Congress jumps on these issues and lets the USSC determine if they can do so constitutionally later. Has the USSC ever returned a law to Congress and said, You cannot do that! ?

At all. I simply want SC Judges that do not add or take away from the Constitution. If we are blessed enough to get that, we will have achieved our goals.

The 10th Amendment has taken a beating for the last 3 decades. I sometimes get very upset at the way FReepers jump for joy when an activist judge "activates" in a direction that is preferable to "our side" and scream when it goes "the other way."

Legislating from the bench is bad -- period. That it happens to coincide with some agenda should be irrelevant.

It appears we've ended up with another O'Connor or Kennedy....

Nope, she does not have an intellect that even approaches that of this man. He will respect and be guided by the Constitution. Unless we are saying that what we want are Justices that will rule OUR WAY (not a truly conservative position), this man is a gem.

Exactly. Obviously, as a 22-year-old, I have no legal experience either nor do I intend to go into any legal profession. It seems to me that, although there is a bit of leeway, some things are fairly obvious. And it's obvious even to my father, who is pro-choice, that abortion is not supported by the constitution. And I believe it will be overturned. I am only interested in whether he's a constitutionalist, as Scalia put it. Is it in the constitution or in the law? That's the issue.
