Day 3: Questioning Continues
This morning, Round 1 concludes with Senators on the Judiciary Cmte. who did not question nominee Alito yesterday. During Round 2, questioning is limited to 20 minutes for each of the eight- een senators. Chairman Arlen Specter (R-PA) leads off, followed by the others, alternating by party in order of seniority.

Why does no one point out that if Roe is declared unconstitutional it will then go to the States to decide their own laws on abortion.
Does anyone think that California or New York would ever ban abortions?

I've come to the conclusion that most people in IL are fairly apathetic towards politics. So, I don't think it will make any difference at all.
Sure there are plenty of political junkies, but with the dead still voting in record numbers it's hard for some people to get motivated to care.

...And I know Senators aren't supposed to say things like that...
But it means so much coming from a Senator like Joe (bye bye) Biden. I wonder if NOW will tear him a new one for that comment?

I DO feel constrained to remark that the good judge is a little politically tone-deaf when it comes to replying to sympathetic Pub questions which set him up for a short, honest, positive reply. He's making the mistake of re-trying the cases referred to and not getting the point of the assistance the questioner is trying to give him.
I wish he'd not go into such excruciating case detail which uses up the time of the Republican senator. Better to filibuster with mind-numbing detail when a DimBulb is the questioner.
Brownback was just setting up some good questions to get to a positive point and he had to jerk Judge Alito back from an eyeglazing replaying of some case he was involved with. The judge never had a clue of the set-up Brownback was weaving.
The judge's "shepherds" should have a little talk with him during potty break. It's too late in the hearing for the judge to give overly-long, detailed answers to every single question being thrown at him. The more he talks now, the more his remarks will be under scrutiny. There's value in the saying "Slow down when you're ahead".

Does anyone know how the RINOs are leaning at this point? I havn't heard about how Collins, Snowe, Hagel, etc. feel about Alito. Snowe met with him and was "satisfied." This was back in November or December - I doubt the hearings affect her first impression.
Alito is doing fine. Ohhhh - Judge Napolitano's name makes its way into the hearings! Funny way the world works these days. NExt thing you know, Carville will be invoked by the DEMs ;-)

I've noticed that too. Not necessarily a good sign, but I haven't researched Alito opinions on that subject.I didn't expect Alito to say anything. But I wonder why these Senators, who will pontificate about anything and everything, haven't said a bloody thing about a stunning act of judicial malfeasance.

Kelo is a decision that very, very few politicians will dislike. There is a lot of $$$$$$ in real estate development for local and state politicians -- and if a few houses have to get bulldozed to get the development done and the bucks paid into re-election campaigns, then that's what has to be done. Nobody on either side of the Committee table is going to bring that issue up -- they're all in bed on this one.

What bothers me is that if he answers Brownback's questions about issues that might come up before SCOTUS, he will have to also answer Dem's questions. Hope it's a pitfall he can avoid!
