Granted I haven't listened to every second of the hearings, but I don't think Kelo has been mentioned even once. And that astounds me!
I beginning to think that. I watched Bewitched, not a great movie, but the scene in which samantha is making him read his lines with different accents and approches at the dinner is great -- and when you realise that he had to be able to DO all those different voices and approaches, it made me realise how talented he was.

I have a book that is copywrite 1913 titled "The framing of the constitution of the United States" by Max Farrand. It is old but like the constitution its still good.

I've noticed that too. Not necessarily a good sign, but I haven't researched Alito opinions on that subject.
That was so obvious that I can't believe the dems ever tried to assert that no 'settled' cases could possibly be overturned.
Could they be tippy-toeing around Kelo because it is so recent and Souter is out there and might be embarrassed? If so, it is not a good reason.
