Now from a Constitutional standpoint there should be no federal established religion per se. However the Framers would have assumed the legislation passed by the national legislature would have some flavor of religion to it.

As to the legislatures of the separate and sovereign states, such limitations did not apply

Indeed. And a person who does that is wrong to do so. Society has a responsibility to punish those who murder. that punishment, in my opinion, should be a lifetime of imprisonment, so that they might consider the error of their ways.

He's had 26 more years than each of his four victims. That's 104 bonus years beyond when justice should have been served.

I am still floored by the inference that it's easy to kill him when these charges date back to 1979 and there's an automatic appeal process.

Unfortunately, this is being framed as Schwarzenegger against Tookie, as if the Governor is the only one deciding. The fact is, prior to this moment, a prosecutor had to decide to seek the death penalty; 12 jurors had to unanimously agree to the death penalty; the presiding judge had to agree; several layers of appelate courts agreed; and now the Governor merely has to enforce their decision.

It is hardly one man deciding the fate of another. Schwarzenegger only needs to reaffirm his respect for the decision made by those many people. Or he needs to say they were all wrong.
