Actually, I think you will find Kennedy becoming more consistant in his rulings in the coming years.
I think Stevens will retire next year (at the end of the court year).

The consitutional requirements of a nominee lie only in ther advice and consent of the Senate. Pee Wee Herman cannot meet this requirement. The only reason Miers withdrew is because it was becoming apparent, without support of the R Senators, that she was "unqualified" also. Ok, we are in full agreement. It is APPhys who is arguing that one cannot call Meirs unqualified.

I think that the WH needs to pressure ASpecter to act as a Committee Chairman and not a committee door-mat!
As chairman, he is allowed to frame the hearings. He may install standing rules according to RRoO. (He can disallow certain lines of inquiry.)
Again, the 7 RINOs and Specter need to be pushed HARD by the WH, by the new media (us!) and by their constituents to make sure the Constitution is not amended by minority fiat!

Why were YOU not asking that Miers have an up-or-down vote in the Senate?
THAT is the ONLY Constitutional course of action for the Senate.
The "Conservatives" who defeated Miers have abandoned the principle claim that an "originalist" reading of the Constitution is desired above all else.
I would not have had any problem with a defeat of Miers by a vote on the floor of the Senate. I don't have any problem with withdrawing her nomination after it became clear that she didn't have sufficient support to pass muster in the full Senate. It is the unConstitutional process of denying her that vote by the Judiciary Committee conservatives maneuvering, and their demand that the executive branch release privileged documents, that I have a problem with.
I can't understand why people in the conservative movement abandoned the principle that an originalist interpretation of The Constitution was important, ironically during a battle "to install an originalist".
