WASHINGTON - Rebounding from the failed nomination of Harriet Miers to the Supreme Court, President Bush is poised to select between two of the nation's leading conservative federal appeals court judges - both experienced jurists with deep backgrounds in constitutional law - for what promises to be a bruising Senate confirmation battle.

With an announcement expected Sunday or Monday, administration officials have narrowed the focus to Judges Samuel Alito of New Jersey and Michael Luttig of Virginia, sources involved in the process said. Both have sterling legal qualifications and solid conservative credentials, and both would set off an explosive fight with Senate Democrats, who are demanding a more moderate nominee to replace Justice Sandra Day O'Connor.

Bush should tell his base....."Now,.....you can deliver Luddig......right?

Lets get on with it. Let McCaine, SNowe, Graham, and the rest know that they will not have a seat at the table if they do not get in line with Bush on the Luddig appointment.

Great news. No more surprises. Just pick between Alito and Luttig and conservatives will be very happy.

Rereading the Rosen piece, Luttig would be the better pick. Alito ruled that the feds could not regulate the posssession of machine guns, allegedly. That will be all over the Dem ads against him, and fair and damaging comment.

All the better reason to revere Alito. Either will do in this situation.

Very true.

I'd be happy with 15 or so possibles, and I'll support them if solid, but a real heavy weight would be nice.

Luttig or Alito are good.

And if he wants a woman, go to Jones or Brown.

Miers was not an "abomination", even if picking Miers arguably was.

I agree wholeheartedly with this. Few have been as vociferous as I about her lack of qualifications to serve on the SCOTUS; however, that does not diminish her as a person of accomplishment in her past endeavours or indicate that she will not be equally successful in her future life.

I must point out, however, that there have been as many ad hominem attacks against anyone who dared oppose her confirmation as there have been against the nominee herself.

This nomination caused an alarming amount of emotional turmoil. For that reason, alone, it is probably a good thing that she withdrew.

Don't get too excited about my following comments, made in jest, as my Grandparents came from Palermo.

Alito and Scalia, two guineas on the Supreme Court, it's a great day for the mafia.

Hey, if the brothers can do it, why can't we Italians? Flame away with the pious, pompus, politically correct pounding. I posted this after re-reading it and know that some will be offended. Feel free to be offended.

To nitpick, Earl Warren wasn't a former legislator. He had been a district attorney, attorney general, and governor of California, but had never served in the state legislature or in Congress, so he never wrote any laws...until becoming Chief Justice.

There is no point in a majority if it doesn't have the courage of its convictions. The sissies must learn that it's time to fish or cut bait. In a way I hope they cut bait so real, courageous representation will follow. But the sensible side of me just hopes they do whats right tomorrow.

It's tough to pick.

Would looking over #75 on this thread make it any easier at all?

My bet is Sykes or Williams.

If I had funded my tradesports account I'd wager on Judge Diane Sykes.

But Souter needs to stay on until our hotel is built.

Are they going to take his home by eminent domain and put up a hotel? Is that just a rumor?

I would accept either of those picks- not because they are women, but because they are qualified.
