They don't have list of candidates at the heart of the laundering case, just a 'similar' one
AUSTIN - Travis County prosecutors admitted Friday they lack physical proof of a list of Republican candidates that is at the heart of money-laundering indictments against U.S. Rep. Tom DeLay and two of his associates.
The list is key to prosecutors being able to prove that corporate money that could not be legally spent on Texas candidates was specifically exchanged at the national level for donations that legally could be spent on Republican candidates for the Texas House.
Indictments against DeLay, Jim Ellis and John Colyandro state that Ellis gave "a document that contained the names of several candidates for the Texas House" to a Republican National Committee official in 2002 in a scheme to swap $190,000 in restricted corporate money for the same amount of money from individuals that could be legally used by Texas candidates.
But prosecutors said Friday in court that they only had a "similar" list and not the one allegedly received by then-RNC Deputy Director Terry Nelson.
A lawyer for Ellis said prosecutors' inability to produce the list mentioned in the indictments is on par with the tactics used by U.S. Sen. Joseph McCarthy in the communist witch hunts of the 1950s.
"I'll tell you what I think about this list. In the 1950s, a man named McCarthy claimed to have a list of 200 communists in the State Department, and he didn't," said J.D. Pauerstein, a lawyer for Jim Ellis, the director of DeLay's Americans for a Republican Majority. "They (prosecutors) don't know what list they're talking about, even though they specify it in their indictment."

So, how come the Repubs aren't going after Sen. Clinton for the $2,000,000 she failed to report on her campaign finances?
It seems Repubs are afraid to do much of anything!

I do remember this particular ex-newsreader had a real thing for Fidel Castro and Sadamm Hussein. Not sure if these are good enough clues for you to help me jog my memory. I do remember he was quite a bit younger when he was enamored with Castro. By the time he and Hussein consumated their mutual admiration society they were both a bit long in the tooth. Now I'm not one to start rumours so I'm sure these 2 relations were purely platonic even though the admiration and adoration shown out of this newsreaders eyes.

The problem with Senator McCarthy was, being a communist was not then and is not now a crime.
Of course the country was infested with KGB agents and traitors. This was the cold war, after all. One presumes that actual KGB plants were smart enough to wrap themselves in the flag and not raise suspicion about themselves.
AFAIK Senator McCarthy never convicted anyone of an actual crime (such as treason, espionage or sabotage) or even produced any actual evidence.

Much as we'd all like to round up the gang over at DU and deport them to Cuba or North Korea, that would be legally and morally wrong.
That being said, I would like to see some of the actual traitors (such as Hanoi Jane Fonda and JFKerry) prosecuted for their crimes. "Giving aid and comfort to the enemy" is still a crime under the United States Code.

Absolutely correct. Even today, we must be on guard to prevent the infilitration of enemies into our society. It's real and a constant danger we must be on guard against.
Problem is today with the political correctness, we don't go after the culprits with the full weight of the law.

In my experience, and in this case...there is real truth in the activity under investigation...but the tactics used to get to the truth often becomes the issue.
And, unfortunately...wih hot issues like this, even to be questioned...marks a person as guilty in the eyes of the uniformed. Hysteria overrules reason and the wait for factual information.
It was never about proof. The 'Rats just wanted to indict DeLay to force him to step down from his position in the House. Their tactics now will be to drag it out as long as possible.

WOW.... if this is true, and they can prove jury shopping, this guy could be disbarred.

If that's the case and the prosecutors are as competent and as astute as was Judge McCarthy, Ellis et al are in deep shit!
