MIERS & LAST-MINUTE DROP-OUTS [Kathryn Jean Lopez] A journalist friend just spoke with a top Texas lawyer who spoke with Priscilla Owen last week. He says that she "most emphatically" did not withdraw her name from consideration to the Court. If the White House spin is that Harriet Miers got the job because nobody else wanted it, it would seem that the White House is at a desperation point. Posted at 12:07 PM

Then you don't know Laura. I think wild horses could not have prevented Laura from defending her friend. I don't think Dubya would have been able to stop her if he wanted to.

We're really in agreement (and both blue in the face, LOL!)

That is when this fight should've been picked and fought. Bill Frist should've called the question, made the Dems object, let Cheney rule from the chair and we should've gotten it on then and there and settled this. I think we'd have won then. I don't know that we'd win now. But Frist didn't do what he should've done, I don't know why the White House didn't jack up the pressure to make him do what he should've done, and we've wound up with the Gang of 14, and the present mess.

I've seen this frenzy equaled or close to this level anyway twice in my nearly 5 years here...Arnold Vs. McClintock in the Recall election, and the Terri Schiavo situation last spring.

the WH was told by members of the gang of 14 on BOTH sides of the aisle that Owens and Brown would be filibustered

If this were true, why isn't the Whitehouse conveying that message to conservatives? They've tried every excuse in book, including insulting the intelligence of their most faithful backers. Why don't they just come and tell it straight-up: while Miers isn't the most qualified, she's the best qualifed who can be confirmed. It would go a long way towards pacifying the right; I thought that a man like Bush knew that honesty is the best policy.

1) Owens is a team player who slipped up. - Then why is she leaking info to the press against the White House and now going through friends of friends to get the message out? Doesn't sound like a team player to me.

2) The White House had a plan to implant a moderate SC nominee. - The confirmation hearings will shed a light on that to me, not a FR poster. All signs show that she is a very conservative woman.

3) Dobson was used by the White House - Dobson put his two cents in without being prepared. It was his interview with Brit Hume that set off the Dobson firestorm. Unless you believe Brit was set up or helped set up Dobson?

4) The White House plan of dis-information was busted. - Disinformation is where it has always been - the media. As I stated earlier, NRO reported before the Miers nomination that their sources said Owens took her name out of contention. Are their sources correct now or then? They report rumors, you decide.

Please point me to a statement from the White House which says “We tried to give this SCOTUS nomination away, but no one would take it. No one wanted the job. Finally, Harriet said ‘Oh, I’ll take it.’ Frankly, we were relieved. We thought we’d never find anyone willing to sit on the bench.”

The White House doesn't work that way. They put out talking points for others to spin.

I've been saying for a while that if she is looking at the current situation, maybe she'll fall on her sword for the good of the party and the administration.

Pretty insulated from the trenches, and they are relying on polls that indicate adequate support.

I see what you're saying about Hillary, but I imagine that should she be nominated for SCOTUS and should she take a Ginsberg / Roberts style path through the questioning she would be confirmed. The Constitution seems to imply that by electing a President we give that person the authority to use their judgment in selecting members of the supreme court. Miers wasn't even on my personal radar of people I thought best for the position, but I don't see any reason she could be deemed unable to perform the duties of the supreme court. Is there a genuine objection which we could raise of which you are aware?

When did this become a crime, if I might be so bold to ask? Golly, doing what the people who elected him want him to do - isn't that what our elected representatives are supposed to do? Be the voice of the people? This is still a republic, isn't it?

My prediction, and I'm really bad at these, is that Miers goes through the confirmation hearings, a lot of squawking happens on both sides, but by a narrow margin she is passed on to the Senate which gleefully sends her on with a 90-9 vote. The swing-set is filled once again.

The White House picked this fight, no one else. Why did they need to pick a woman anyway? Where is that rule written down ,as the defenders of her keep asking us, that this seat needed to be filled by a woman?
