Sen. Barbara Boxer said Wednesday she would vote against John Roberts' nomination to the U.S. Supreme Court, if she remains convinced he doesn't support abortion and privacy rights.
"I need to know exactly where he stands and I need to know whether he would fight to protect the rights and freedoms of the American people," said Boxer, D-Calif. "If I don't believe he will, I won't vote for him."
Boxer said she was withholding judgment on whether she would vote for President Bush's pick to succeed Justice Sandra Day O'Connor, who often provided the decisive swing vote in decisions that spit the court's liberal and conservative wings.
"Imagine what is riding on this one Supreme Court vacancy," Boxer told an audience of about 200 at Golden Gate School of Law. "This one vote means so much to countless women."
Boxer fears a more conservative court could lead "to the days of back alley illegal abortions."
"We cannot go back to those dark days," she said. "Judge Roberts cannot duck this issue."
Roberts has been on the U.S. Court of Appeals for the District of Columbia Circuit since June 2003. He was associate counsel to President Reagan from 1982-86 and then served in the first Bush administration, arguing cases before the Supreme Court from 1989-93.
Boxer said filibustering Roberts is an option.
"I have the ultimate step. I can withhold my approval. I can use all the parliamentary rules I have as a senator to stand up and fight for you," she said.
Included in her criteria for supporting Roberts is his taking a strong stand on the right to privacy, which Roberts called a "so-called" right while working as a government attorney.

At this rate, eventually there won't be a next election for them.
Remember, this is why they are so adamant about extending voting rights to convicted murderers and rapists, illegal aliens and convicted drug dealers. They want to outlaw positive identification at the polling place to facilitate their frauds.

It's a hideous commentary on humanity when millions of people wake up each morning utterly DRIVEN to do everything within their power, by any means necessary, to preserve the ability (I refuse to call it a right) to slaughter unborn children. They are totally consumed by the issue, distraught at the notion that these babies might be protected and given a chance to live. It's a wonder God hasn't just swatted us out of existence.
