Michael Schiavo Poised To Sue Caregivers

CLEARWATER - Michael Schiavo has asked a court to waive the two-year statute of limitations on filing a medical malpractice lawsuit against one or more of his deceased wife's caregivers.

Terri Schiavo, 41, died March 31 after her feeding tube was removed after a seven-year court battle.

Schiavo's attorney in this case, Mark Perenich, said he was not able to discuss the proposed lawsuit behind Tuesday's request for an extension of the two-year statute of limitations.

By law, medical malpractice lawsuits must be filed within two years of the alleged misconduct unless an extension is granted.

In October 2003, Terri Schiavo's feeding tube was removed on court order. Doctors reinserted it on orders from Gov. Jeb Bush.

Oops, I didn't mean I find merit in a suit against the nurses, just that I agree that it might be a valid speculation by the author of the piece! Poor sentence construction on my part!

The speculation regarding suing the Governor and Legislature is flawed because that happened less than two years ago, and both would be immune from such a suit, anyway.

And I can't imagine the legislation barred him from filing suit anyway, which would be the only connection to the limitations.

suit against the nurses might have merit, but can you imagine the theory of the case? They committed malpractice by cutting her nails and brushing her teeth?

If it was ongoing, and they weren't fired, someone needs to sue Teri's guardian.

There is a bright side to everything. Maybe "discovery" would be interesting. I think alot of things might get re-investigated if he sues. One might be, that there was no evidence of bulemia, which he sued for in the first place. If they counter sue, he could be "disgourged"(have to give the first award back).

I think he should probably leave it alone. He probably won't if he is the egotistical maniac that I think he is. After all, he just got away with murder. I have an ex- brother in law like that. The same as the Van der Sloot guy in Aruba. Gets his way all the time, even if he means he has to kill to get it. They even look the same.

A bit of poetic justice. As I recall his attorney had a financial interest in the nursing home, who I presume is a target of the lawsuit.

Well that would be funny, but I suspect he's not going to sue the hospice, just the docs who treated her when she collapsed. Though hasn't he already gotten a settlement from the insurance companies for that phase? Greedy little bugger - double dipping....

Perhaps he's going to sue the original doctors....the ones in the ER. They kept her alive when she was supposed to die. Poor Mickey was forced to sue the personal doctor and go through years of pure hell trying to kill her because of the ER docs screw-up.

You're right, IMO, if he wants money he should write a book, which I'm sure would become a TV movie. He could play himself.

I figured it would be in there....he seems to be real good at filing lawsuits....he's been doing this now, full time, for 15 years....he probably prefers this to working...oh, that's right...Terri always supported him when she could talk...now that he's got her dead, he wants her to support him from the grave...

Words fail me, they always do when it comes to this murderer.
He remains proud of the fact that he made Terri and her family suffer and will prolong her family's agony as long as possible. Little does he know that he is prolonging the suffering he will someday endure because of this.
