Group withdraws its support for nominee Roberts

Conservatives cite his work in a gay rights case

WASHINGTON - A conservative group in Virginia said Tuesday that it was withdrawing its support for Supreme Court nominee John Roberts' confirmation because of his work helping overturn a Colorado referendum on gays.

The group, Public Advocate of the United States, is one of the first conservative organizations to announce anything but support for the judge

Eugene Delgaudio, the president of the group, said that he hopes his stance will prod others.

"I know that others feel the same way. I know they believe as I do. They're just not going to act," the northern Virginia man, 50, said. "But once I've done it, then they can't claim that no one's opposing Roberts."

"We can't take our limited resources and put it toward a candidate who is not a strict constructionist when we were told he is," Delgaudio said.

The stance by his group, which describes itself as a pro-family organization, puts it in opposition to conservative groups that have endorsed Roberts. A number of liberal groups already oppose President Bush's high court nominee.

Roberts met Tuesday with one senator who is undecided on his nomination, Oregon Democrat Ron Wyden, who said the nominee "would not look favorably" on Congress acting to intervene in an end-of-life case such as Terri Schiavo.

Wyden said Roberts told him that Congress can prescribe standards, "but when Congress starts to act like a court and prescribe particular remedies in particular cases, Congress has overstepped its bounds."

Congress pushed through unprecedented emergency legislation aimed at prolonging Schiavo's life by allowing the case to be reviewed by federal courts. The courts rejected that effort.

The Colorado gay rights case involved Amendment 2, a constitutional amendment approved by voters in 1992 that would have barred laws, ordinances or regulations protecting gays from discrimination by landlords, employers or public agencies such as school districts.

Gay rights groups sued, and the U.S. Supreme Court declared the measure unconstitutional in a 6-3 ruling in 1996.

Roberts' role in the case included helping develop a strategy and firing tough questions during a mock court session at Jean Dubofsky, a former Colorado Supreme Court justice who argued the case on behalf of the gay rights plaintiffs.

Has anyone here ever heard of "Public Advocate of the United States"? I haven't heard of them before.

Ok, who has ever heard of them before?
Thot so.

Has the AP ever mentioned them before?
Thot so.

They may be a real group, but it wouldn't surprise me
if Legacy Media or their pals in the moonbat fake news
industry invent non-existent "conservative" groups to
oppose Roberts.

If the left really wants to defeat Roberts, they only
need to get Kennedy, Schumer or the NYT to endorse him.

Yes it is. While the AP and other socialist news organizations will try and stir up as much trouble as they can about it, we need to use caution in judging his actions on this past issue. Knowing what we do know, about the man, it could very well be that his actions were not in any way political, and were just to practice and uphold the law. But again, hard to say.

It would be nice to think there are still lawyers and judges that do act in the purest sense of their job, and do not let politics play a role -- we would not have the problems we have with liberal activism in the SCOTUS and elsewhere all over our nation now. I guess it is difficult for some to even consider the possibility that the judiciary and not horribly political now, especially in light of what we see daily....tough call.

If Roberts gets on that court gay marriage will be made legal.

Of course you have no proof to back up that statement except a story from the LA Slimes.

What's a pity is that you don't know the facts.

I'm confused, does that say that the Supreme court said it's unconstitutional to deny special rights, privileges and status to perverts?

"What's a pity is that you don't know the facts."

According to the AP as related in the Houston Chronicle Roberts' role in the case included helping develop a strategy and firing tough questions during a mock court session at Jean Dubofsky, a former Colorado Supreme Court justice who argued the case on behalf of the gay rights plaintiffs.

Of course, you know all the real facts, but you do not care to reveal them at this time, seeing as how you have many more important things to do, ergo, you simply take a potshot.

I have met Delgaudio. It is on the Board of Supervisors representing part of Loudoun County, VA. He is a very animated and outspoken character to put it politely.

I don't doubt that one minute. Even most conservatives, I would dare, would agree that the Federal government cannot recognize every singe marriage in the country EXCEPT the gay marriages of Massachusetts.

I believe Roberts would have no choice but to see this as an equal protection violation.

Before you flame me, keep in mind that this is why a Constitutional amendment is required if gay marriage is to be kept illegal.

Ok, what I would really like to say would get pulled but ...
Anyway, there was advice to some pro-bono work. It does not in anyway signal a pro homosexual stance.
It is beyond me the idiocy of some conservatives.
