ACLJ Calls John Roberts, Jr. - President Bush's Supreme Court Nominee - an "Exceptional" Choice Who Will Interpret the Constitution

July 19, 2005

(Washington, DC) – The American Center for Law and Justice (ACLJ), specializing in constitutional law said today that John Roberts, Jr., the nominee named by President Bush for a seat on the Supreme Court of the United States, is an exceptional choice who will bring sound legal reasoning to the high court.

“Judge Roberts is an exceptional choice who will bring sound legal reasoning to the Supreme Court of the United States,” said Jay Sekulow, Chief Counsel of the ACLJ, who argues regularly before the high court. “He was one of the most gifted advocates before the high court and has served with distinction on the D.C. Circuit Court of Appeals. In my dealings with Judge Roberts over the years, I have found him to be a ‘lawyer’s lawyer’ exhibiting uncommon insight and judgment. A man of character, Judge Roberts understands the Constitution and has a record of applying the law – not legislating from the bench. He is extremely well suited and well qualified to serve this country on the nation’s highest court. We call on the Senate to begin the confirmation process and move swiftly to conduct fair hearings and to confirm this exceptional nominee.”

Sekulow, who argues frequently before the Supreme Court, said the ACLJ will begin mobilizing a national campaign to ensure that Judge Roberts is confirmed. Sekulow said he will generate support for the nominee through his daily radio broadcast that reaches 1.5 million listeners, through his weekly television show, by using direct mail, phone calls, and emails to a list approaching one million supporters.

“We are prepared for a very intense battle that is certain to begin immediately,” said Sekulow. “We already have experienced the obstructionist tactics used to keep President Bush’s federal appeals court nominees off the bench. This Supreme Court nomination represents the culmination of years of preparation and focus. And we are prepared to ensure that the Constitution is complied with in this confirmation battle. We support President Bush’s nominee and are launching a national campaign to ensure that the nominee is confirmed.”

How can Jay or any Christian-conservative endorse this man when Roberts' has been quoted to say,

"Roe v. Wade is the settled law of the land. ... There's nothing in my personal views that would prevent me from fully and faithfully applying that precedent."

Garbage is right! I sat here last night not believing what I was reading from some of the doom and gloomer's (d&g's)with their little black cloud posts. I was so glad to read this email this morning and know someone I respected thought the Roberts was the man for the SCOTUS.

I was so glad to read this email this morning and know someone I respected thought the Roberts was the man for the SCOTUS.

Me too...Jay is so trustworthy...God Bless President Bush for doing what he said he'd do. President Bush kept telling us we'd be happy over his pick and he does what he says he'll do....Praise the Lord...he did. ;o)

When I see the number of conservatives lined up in favor of this pick and the Schumers going over the cliff along with Planned Parenthood and the rest, knew it was a good pick but Jay put the icing on the cake for me!

I am not a lawyer or Judge, but if I were a Judge for the position that he was seeking, I'd have said the same thing, knowing in my heart that (a) Roe v Wade was a bad decision and (b) abortion is wrong.

Why? It's the fault line between the Judge Moores and Bill Pryors. If you believe in the RULE OF LAW, you have to uphold laws and rulings, even if you disagree with them.
Some conservatives somehow think if their personal views don't comport with a ruling, they can 'opt out' ... but to allow that thinking is to invite chaos in the law. If Judge Moore thinks that his own personal beliefs entitles him to ignore a federal judge's order, then who's to stop a Liberal judge from insisting that the Constitution demands gay marriage, and starts issuing licenses??? ...

Laws are not cafeteria selections, you can't just pick the ones you like and ignore the ones you don't. A Judge's job is to uphold the law. Roberts was correct that from an appeals court judge perspective, Roe v Wade was settled precedent - and will remain so until the Supreme Court rules otherwise.

Our task is to make sure that someday the USSC *will* rule otherwise.

Jay did that for me too. I felt in my spirit Roberts was the right man...but when Jay endorsed him that made my year.

It's too bad our Christian leaders don't have the same high standards as Ann Coulter. The facts that we don't know if John Roberts would vote to overturn Roe vs. Wade. In fact, many people that know don't think he would. Christian leaders and pro-lifers need to demand judges that have proven track records on the issue.

Ann Coulter saying what the ACLJ and Jay Sekulow should be saying:

Maybe Roberts will contravene the sordid history of "stealth nominees" and be the Scalia or Thomas Bush promised us when he was asking for our votes. Or maybe he won't. The Supreme Court shouldn't be a game of Russian roulette.

If a nominee, any nominee, is truely pro-life, then what he needs to say is this,

"I will fully adhere to the constitution and the rule of law. I also believe that the Roe v. Wade decision was unconstitutional and given the opportunity, I will vote to overturn it.

I think Coulter may be running interference on this one to confuse the libs. This column on Roberts is devoid of actual substance which is quite unusual for Coulter. Just think how confused the leftists must be if they find themselves agreeing with Coulter. They will probably find themselves supporting Roberts just because Coulter is against him. I wouldn't be surprised to find out Coulter worked this out with Rove beforehand.

From an AP article -

In a brief that he filed with the Supreme Court while serving as deputy solicitor general in the administration of the first President Bush, Roberts said that Roe v. Wade "was wrongly decided and should be overruled." But he told senators during his 2003 confirmation hearings for his current appellate court post that the decision was "the settled law of the land."

Sounds to me like he's against Roe but for upholding the law. Hopefully that means that were he in a position to change bad law, he would do so. Plus, as others have noted, sounds like his wife used to run a pro-life org.

Anyone who wants to sign the ACLJ petition can go HERE

If you don't want to get email bulletins from ACLJ just click where indicated near the bottom of the page. If married be sure to add spouse's name where indicated so both names will count on the petition.

This petition won't do any good where liberal Dem Senators are concerned, but maybe some wobbly Pubs would pay attention to several hundred thousand voter's signatures. In any event, it can't hurt and it might help.
