Sen. Boxer Calls Nomination of Supreme Court Justice " an Extraordinary Circumstance"

Senator Barbara Boxer appearing on Fox News this afternoon was asked about the 'Gang of Seven' deal not to Filibuster nominees unless it is Extra-ordinary circumstances; declared that "with the right to privacy and Roe v Wade on the table this is an Extra-ordinary circumstance and the Filibuster is on the table".

Well people they just moved the goal posts.

+1 Dick Cheney to break the tie.

Why is it wrong to call for judge Greer's impeachment but not wrong to practice what I like to call selective impeachment, that is, having a pro-abortion litmus test to simply dismiss any prospective judicial nominee who is not liberal enough?

Boxer can vote based on litmus tests, the Zodiac or numerology for all I care. Just so long as the rest of the Senators are allowed to vote as well.

The Democrats will come to rue the day the Supreme Court handed Roe vs. Wade. It has united people against them like nothing else could. Absent Roe vs. Wade, there would be no Conservative movement in this country.

The Republicans have the votes in the Senate today because of Roe vs. Wade. It is time for that pendulum to swing back the other way.

That's a worst-case scenario too. More likely, we will have 5 or 6 of the Gang of 7 Republicans, plus 1 or 2 maverick Democrats. That would lead us with at least 53-55 votes.

A small problem in your equation. There are 100 senators and the VP only votes in case of a tie so it would require 51.

Beg to differ with you. IMHO, Frist doesn't have the guts to pull out the nuclear option plus it's the gang of 14 that run the Senate, not Frist.

It really doesn't matter if Senator Nelson is for or against the Nuclear Option. We don't need any Democrats for the nuke option, only 2 of the seven republicans in the gang of 14 plus Dick Cheney. Lindsey Graham, John Warner and I think John McCain have already said publicly that if a filibuster is started without "unusual circumstances" over an appointee, they will support the nuke option.

Yes, but remember, the two RINO Senators from Maine--Snowe and Collins?--sent that letter to O'Connor asking her to stay on the Court to prevent a nasty confirmation fight.

It wouldn't surprise me to see those two and a couple of other limp-spined RINOs *not* in the Gang of Fourteen backstab Frist on attempting to invoke cloture. There's 55 Pubbies in the Senate, you know a couple will defect, he'll need 7-10 Rats to go along with him to be sure of shutting down a filibuster. Sounds like the Nucular(tm GWB) Option may be the only way to do this, if Babs is right and the deal is off.

I said as much myself three times in this thread. Except for one thing: Specter is NOT one of the gang of 14. I'd be surprised if he goes nuclear, so I figure we need three of the gang to go nuclear.
