Actually, take heart from all who seem to misconstrue her "settled law" statement. The idiot RATs will make the same mistake, her nomination will sail through, and then reality will set in.

Are you a Pat Buchananite? If not you could have fooled me. He is so called pro-life but is the meanest Republican i have ever met,and the only good thing he ever accomplished was he destroyed that worthless third party.

Judges are not necessarily the same kind of political animal as Senators (Barf-hack)

I've been sitting here trying to figure out why Clemont saying that Roe is settled law is causing so much panic among the pro lifers on this thread.

Because it could well mean that she doesn't think Roe should be overturned because a precedent has been established. The point is we don't know. The pick is a Russian-Roulette pick.

OK I get you now. I think she should refuse to answer such questions either way. It has nothing to do with the rule of law. In order to have a shot at over-turning Roe and all the other rotten laws is a systematic takeover and the right type of case has to make it to the court. I would love to see Roe overturned today, but reality is that it will not be, we need to keep winning elections and keep getting these liberal activist judges off the bench. I really think that the President is going to do the right thing, and if it's a shoot-out then so be it.

I don't remember anybody ever assuring anybody (convincingly) that Souter was a conservative - at least nobody outside NH

What confuses me is that several sources the last have strongly implied that Byrd has signed off on the nominee. Makes sense if the WH can pull it off..but the Dems would have leaked it already...also, no way Sheets signs off on JRB..I think it's NOT Clement...this is all disinformation..

No, but she's a fixture here and I respect that.

In the meantime, keep this in the back of your head...

Catholic and a Member of the Federalist Society is good news, in my humble Catholic, Federalist Society member opinion.

If anyone at this site has as much knowledge as I do about judges and their different philosophies, I'd be surprised.

Ah, yes, now I'm convinced ROFLMAO

Oh really - please direct us to your source of esteemed knowledge in these regards

Yeah, see that's the problem, now isn't it? No one, on either side of the question, can point to definitive evidence of Judge Clement's judicial philosophy or her theory of jurisprudence.

And past history indicates quite strongly that those candidates who do not possess a proven track record of an originalist jurisprudence do not develop one after lifetime appointment to the Supreme Court. You either bring one with you (Thomas and Scalia) or you "grow in office" to the delight of the liberal establishment.

Them's just the facts, jack. Sad, but true.

Now, Clement could break the mold. Or she could have a track record I'm not familiar with that paints her as an Originalist. But the concern some have is legit, even if it's expressed in a less than articulate way.

What makes you think she'd vote to uphold Roe?

What makes you think she won't? The point here is that we don't know. And, that really isn't good enough given that 55 Republican are in the Senate. It's time to get a backbone and nominate sure things.

Well, to put it bluntly, what person smart enough to be on SCOTUS would be dumb enough to say something contrary?

I have to get something out the door but will try to get that info for you this evening. I need to re-read Burdine myself to make sure that it is as I remember.

Alas, if the rumors are correct and it's Clement, it won't really be all that important, except that it may have been what done the old girl in (that and Jones' McCorvey opinion with which I totally agree).

WTH!

Inside information + she was strongly supported by Mary Landrieu (who is strongly supported by Planned Parenthood and NARAL).

Additionally, Edith Clement has said that the Constitution has granted a right to privacy (abortion). There is nothing in the constitution about that.

I may be wrong, but those are the facts I have.

Garza is a safe choice for US Supreme Court (as far as conservatives go).
