I wonder now what the strategy is going to be with Rehnquist. Will the left simply let Clement sail through, and save their ammo to use against Luttig replacing Rehnquist? Or has the white house tipped its hand to not wanting a fight on any SCOTUS appointments, meaning we get another "squishy" nominee to replace Rehnquist?
I wonder if Rehnquist sees what is going on, and that's why he is going to try and hang on as long as he can, to deny Bush 43 from replacing him with this formula? Maybe he's decided to take a chance on the 2008 election.

Lindsay Graham was on Fox today and said Bush has gotten the green light from some very liberal members of congress. Because of this, I'm not feeling the 'warm and fuzzies' about who he'll nominate. I certainly hope I'm wrong.Normally I'd worry about the democrats cooperating, but they're really between a rock and a hard place here. If they filibuster, they WILL face the constitutional option. So if it's true that they'll be somewhat less antagonistic, it could be because they really have no choice.
I will not allow the words or opinions of a bunch of leftists sway my opinion on the matter. I will base it on the nominee's bio. :-)

Rose..I thought that way also during the campaign..but now I understand Scott's fucntion...McCurry was the prototype of the combative press secretary...Scott is a "pushyme-pullyou"..nothing sticks to him, gets under his skin..he deforms..it's more frustrating to the press, I'd suspect..

Neither Edith is among my first five choices. But Edith I is of proven constitutional philosophy and is VERY strong-willed. She is however a poor public speaker and simply lousy at Q & A even before friendly audiences like the Federalist Society.
Edith I also has views on the criminal justice system which are too strong for even the conservative 5th Circuit and are just unacceptable in my view. The Burdine opinion in which she joined was simply awful, so much so that the 5th Circuit sitting en banc reversed it, a very rare occurrence. This case will give the Dems very effective tools to oppose her.
Having thought about it, I have concluded that Edith I would do less harm with those views on the Supreme Court where she would have to get 4 other votes and Scalia and Thomas would ask her if she were crazy, than on the 5th Circuit where she only needs to get one other justice, like the crazy Rhesa Barksdale, to go along with her.
So I am OK with Edith I. I just fear that her Burdine opinion will doom her nomination. The first time I read Burdine, my very first thought was "Edith, Edith, Edith, you have blown your chance to be on the Supreme Court now." I would not be displeased to be proven wrong.

Could it be Linsey Graham himself? He's been putting himself forward for it. And I think tapping a current senator would make it a LOT harder for the senate to put it a fuss.

You have just made an observation that is both obvious and brilliant. I used to enjoy pressers run by Ari the same way I would watch a sword fight starring Errol Flynn. Whereas, with poor Scott, I turn the things off, usually. You have what Robert Frost called, "a ken eye for the obvious."

My understanding from insiders is that the finalists were all brought to the White House. Judge Jones was one of them. I guess they had set a deadline, but didn't know who it was going to be. Also...who knows, maybe they wanted to have more than oneperson go in so as not to give anything away (not that anyone would have recognized Souter).
So you have this scenario where at least two C of A judges are sitting in the White House to see if they are to be the chosen one. One goes to the Rose Garden. The other goes to the Metro Stop and goes on with life. Apparently the latter was Judge Jones.
Makes me want to cry.
