In the last half hour the new rumor that is keeping political geeks awake: Rehnquist and Stevens resign tomorrow. (Up until a little ago, the buzz was Renquist, as I noted in Bench Memos.) Posted at 10:05 PM

I'm doubtful BUT if it were true, I see W as having to decide between picking three conservatives and having the legacy I think he truly wants, and picking two conservatives and one mod-conservative as a kind of bumper--get them to focus their attention on one or two so one is easier to get in. I HOPE he doesn't choose that option, because he is in a rare position to put in three conservatives and tell the dems to piss up a rope.

This has been my prayer that Stevens would resign. This would give Bush the opportunity to have a 6/3 court and the country would be saved. If Ginsburg is going to resign due to recurrent carcinoma, then a 6/3 split is a real possibility.

I'm almost hoping this isn't true--at least not at all one time. The Repubs will probably stick us with a clinker or two like Souter so we don't appear like we are the mean, greedy Republicans trying to take over the world like the Dems and the media say we are. We all know how Repub politicians are--you can rely on them, they will always let you down.
