Indianapolis, Indiana rushes to use SC ruling to seize property

Last night's local Fox News ran a story that our local government is looking at using this precedent to force downtown landowners out to make room for a new sports stadium.

This was followed by a story announcing a new plan for a rapid transit system which will require the displacement of tens of thousands of homes and businesses.

it's as if the government here has been planning and waiting for this decision to be handed down, and can't wait to start seizing property under this travesty of justice.

No one is safe, not anywhere in the country.

Any state can pass a law saying we won't do it today, and later, when the furor dies down, quietly change the law back to business as usual.

The Constitution is supoposed to be our final line of protection, but the Supreme Court abdicated their authority.

Or worse.

While the transit plan may or may not be a bad idea, your claim of 10,000+ is wildly exaggerated, at best.

Here's some more avenues for fighting this travesty:

From New London's daily newspaper:

"The homeowners predicted that more land in the city would end up in the hands of private corporations.

“I guarantee you that just about every house from Howard Street to Shaw's Cove is going to be targeted,” Beyer said. “I see that whole district in New London as being Pfizer's business park. It'll be like Avery Point minus the houses. You'll have access to Fort Trumbull State Park and that'll be it.”

Beyer, who with a partner had renovated one of his two houses and was working on the second when the city took them, said one bitter lesson he had learned was never again to do business in New London.

And he pointed out the city has never delivered on its promise that Pfizer's arrival in the city would mean lower taxes.

“The city of New London promised all the residents of New London that all your property taxes will be reduced,” he said. “That promise was never fulfilled. The taxes keep going up ... When is enough enough?”

Whats the big deal? Forcing the exchange of one asset for another of equal value? Anyone been to Plymouth (North of Indianapolis). They have a fertilizer plant actually in the town - turns dead and rotting farm animals into nitrogen. Easy to find, head north on 31 then just follow the smell.

I disagree, but it's a non-issue.

Think I-69.

This ruling dramatically increases the leverage the government now has to force people from their land, for ANY project they choose, at whatever prices THEY choose to pay.

For now, I'm willing to fight this war politically, and financially.

If peaceful protest fails, well, freedom isn't free.

Looks like we have a big payment coming due.

You're missing the most important piece of the puzzle -- throw out the elected thieves on the state and local level who are actually stealing our land! Call all of your representatives and let them know that the minute they propose an act of government armed robbery, they will be thrown unceremoniously out of office, either through the next election or through a recall process!

Then we can deal with the enabling thieves in the judiciary.

I think if they want to build a rapid transit that is a public undertaking and they could have seized the homes anyway before the SCOTUS ruling under eminent domain where the gov't takes over the property for public infrastructure needs.

Wrong -- this never would have been in front of SCOTUS unless the elected officials of New London (and your town and my town) weren't so eager to steal our property that they would fight it all the way to the highest levels. The tyranny in this case begins with the legislative and executive branches at the state and local level -- the courts are just in collusion.

That won't happen unless something astronomically outrageous on a level we've never seen before happens. For those who believe in some fantasy revolution that'll save America at the last minute: face it, we're all content with our own lives, or we're too busy making ends meet to worry about being politically active, or we're just plain scared of the government. A few might have the balls to make a Waco-style standoff at their homes when eminent domain abuse starts getting out of control, but most of America will just roll over and take it. And can you blame them? I mean, if they decide to take your home, there's really nothing you can do about it besides challenging it in court for a long time or getting yourself killed in a standoff. The more they erode our freedom, the suckier the options will be when it happens to you. We don't have as many brave patriots today as we did when we revolted against the British for far less than we're accepting from our own government now. Well anyways, this is really nothing new, I guess it only confirms that eminent domain abuse is alright. If they really want your house, they can conduct a phony drug raid on it too. There's numerous ways corrupt politicians can take your home from you, even without compensation.
