Just heard on local news in Houston area that the City of freeport is now going to use it's new taking property power to take the property of a land owner and give it to a developer so the developer can build a private marina.
The supreme court ruled it was up to state laws to decide whether eminent domain could be used for private property. They didn't say it was ok or not ok just that it was not something within their juridiction to stop, and that it was the decision of the state court, and state laws. It's a states rights issue. Eminent domain differs in each state.
Please post any newspaper article about this as soon as you see one. I need credible info to throw in the face of someone else over this issue.
Part of it was a bunch of enviro weenies also, there's ridiculous 'fire safety' laws also. A lot of the water still comes from the Catskills.
I can't see the government getting away with that more than once. With Waco, etc...they had the advantage of being able to paint the victims as nutcases. In property disputes, it's going to be hard for them to tar and feather people who are fighting to keep their private property as nuts. Most people recognize that the SCOTUS failed to do their job yesterday.
That's not what I'm hearing 'round these parts. Lots of verbal "weapon-cleaning" going on.

I find it a little odd that the people at DU are freaking out about this also. Then again, it's probably because it's talking about your property to businesses instead of just confiscating it for government use. Who knows. They claim to be social libertarians and all, but I bet that next time we get a Democrat in office, they'll have no problem at all with government expansion and monitoring, so long as they think that we're the ones targeted.

This lib does not, and this lib is VERY happy and grateful for you "real" conservatives on Free Republic.
It is not just a states right issue. The 5th amendment is supposed to protect the property rights of all citizens. It's not a "gift" conferred upon people by a benevolent government.

Oh, I haven't read the entire ruling but if that is the case than I would expect RED states to pass legislation limiting eminant domain.
One of these days I HAVE to move to a red state. *SIGH*

What they want to build is something like the Kemah Boardwalk, problem is no one will come. Kemah has a lot of people near by, Freeport (from now on Fasistport) does not.
