Las Vegas -- The husband of Anna Ayala paid a co-worker for his severed fingertip to "create a lawsuit" by planting the digit in food at an unidentified restaurant, San Jose police allege in court records filed Wednesday.
The allegation of a widening conspiracy in the chili-finger case came as The Chronicle identified the injured co-worker as Brian Paul Rossiter and reported the man's mother saying that he gave the finger to Ayala's husband, James Plascencia, to settle a $50 debt.
The co-worker's right ring finger was sheered off after his gloved hand was caught in a mechanical truck hoist at a Las Vegas paving firm on Dec. 20, San Jose police Detective Jose Martinez said in a statement filed Wednesday in Santa Clara County court.
"Plascencia subsequently purchased the injured co-worker's detached finger, and advised that he intended to create a lawsuit by planting the finger in food at an undisclosed restaurant," according to the statement.
The statement supported a new charge against Ayala -- of conspiring to file a false claim against Wendy's after the Las Vegas woman said she bit into the 1 1/2-inch fingertip in a bowl of chili at a franchise in San Jose on March 22.
Ayala, 39, who was arrested in Las Vegas a month after the incident, was charged then with attempted grand theft for allegedly concocting the finger hoax against Wendy's. The charge included an enhanced penalty for causing the fast-food giant to lose more than $2.5 million as sales plummeted after the unappetizing publicity.
Ayala, who remained in Santa Clara County jail after a bid to have her bail lowered was denied in a San Jose courtroom on Wednesday, faces as much as nine years and eight months in prison if convicted of all the Wendy's-related charges and...

Caught with a finger in the cookie jar. Make her pay restitution for losses at Wendy's. Or better yet, scrub the restaurants floors for the rest of her life with a toothbrush. That will stop this kind of malarky.
