A mother who gave birth to a twin girl after an abortion failed is suing the hospital for £250,000 to help bring up her daughter.
Stacy Dow discovered she was expecting twins when she was 16 and decided, because of her age and inability to support a child, to have an abortion.
The procedure was carried out when she was around seven weeks pregnant and she was given a contraceptive injection afterwards.
She was told it could cause side-effects, including weight gain, but when she returned to her doctor after 33 weeks she was told she had put on weight because one of the twins had survived. She gave birth to her daughter, Jayde, who is now three, in August 2001 at Perth Royal Infirmary, and is suing Tayside University NHS Trust in a legal action believed to be the first of its kind in Britain.
Miss Dow, now 20, who lives with her parents, Douglas, 40, and Barbara, 41, in Perth, said: "They told me in the hospital that the operation had been successful and there was nothing left in the womb.
"I never had any reason to doubt that and I just put my weight gain and a lack of periods down to the contraceptive injection they gave me.
"When I got to 33 weeks I went to the GP again and he told me I was pregnant. I was absolutely stunned. I didn't know what to say or do. It was obviously too far on to do anything.
''My mother told my boyfriend's parents for me. They were shocked too.
"I had no option but to go through with the birth. I had never been given any warning that the termination might not work properly. I only had a few weeks to prepare for Jayde's arrival. I just couldn't get my head around it. I had never even considered having children. I was too young.
"Although I love her to bits, I have a child now that I wasn't planning to have and I believe the hospital should take some responsibility.
''None of us would be without Jayde now but looking after her has been a financial struggle.
"It has totally changed my life and my parents' lives."
The court papers say that as a result of the failed termination Miss Dow suffered "stress and anxiety upon the discovery of her continuing pregnancy".
The papers add: "She has the financial burden of care and upbringing of Jayde. She suffers an impediment in her ability to obtain employment in consequence of her care for the child."
The action also claims that medical staff at the hospital should have known that further investigation was required after surgery to establish the success of the abortion.
Miss Dow said she had to give up her plans to train as a nurse, and her father, a gardener, had to take on an extra job to support the family.
The trust is defending the action and claims the amount being sued for is excessive.
It said: "As far as could be clinically determined the pregnancy had been terminated.''

what a sick and sad story. I can't even begin to imagine the psychological issues this little girl will have when she gets older and learns about the circumstances of her birth and her mother's reaction to them.
Not only should this woman not be given anything, she should have the child taken away and put up for adoption. The child should never be allowed to learn that her own mother tried to kill her and succeeded in killing her twin.
Nice euphemism for: "I was confident they'd kill the baby."
Abort the mother.

In a just world, the doctor and "mother" would be tried for murder, and barred from their corresponding job functions.

Disgusting. I am glad the child was born healthy or she probably would have murdered it...was a horrible human being this person is. I hope we see God's justice one day soon.

She obviously didn't want the child because she tried to kill it. Since she didn't have the money or maturity to raise the child, why didn't she give the little girl to a family who WAS willing and able to raise her?
