Tonight it is, March 22, 2005, over five days since Theresa Marie Schiavo commenced her ordeal of purposeful and legally sanctioned dehydration and starvation. We await a decision from the three judge panel from Eleventh Judicial Circuit as to her fate, as her family struggles with seeing Terri's physical health deteriorate.
They have de facto rendered the Statute meaningless. They refused to give the Schindlers a de novo trial like the Statute said. They claim, like Whittemore, that the Schindlers did not show that they would prevail in a new trial, therefore they cannot have one.
The Congressional intent was clear, and put in clear language. The Schindlers were to get a de novo trial, period. The courts are saying, oh no, we looked at it based on the case record, and we cannot see that you will win, so no trial for you.
They have done exactly that which the new Statute would forbid, yet they hypocritically claim that they haven't rendered it unconstitutional.
No, they eviscerated it by ignoring what it was telling them they had to do.

You are right about needing the living will and seniors needing to know about it. Terri's plight will help. AARP ought to be on top of it, since their power base is threatened, but they aren't yet.

Yes thanks. I think I'll email that to everyone I know right now. If they think we're going away if Terri dies, they're wrong, their problem is not going away until they fix it.

That's the thing. It may be one of God's mercies in this whole atrocity that all of this is coming to light. Not just with Terri, but perhaps many many others this is being done to. It's chilling.
I'm losing a lot of faith in the courts also. It may also be a good thing if it comes down to Pres Bush or Gov Bush or the DCF taking her into protective custody, to show these judges they aren't in control over everyone else.

Absolutely they could refuse. Just let the 3 judge panel ruling from Atlanta stand, without comment. In fact, I believe Scalia said something recently about the Federal Government should not be involoved in these personal, family, tragic matters. Don't know if he was thinking of this case or not. But he is clueless in that the judiciary is making law on these matters as we speak, and people are being cruelly tortured and killed. What ever happened to "live, liberty and the pursuit of happiness", Mr Scalia? That's not a Federal issue??

Can someone tell me why the lawyer for the Schindlers have not included the affadavits, and all the info WE have to the courts?
I know nothing about him at all. There is FAR TOO much, what appears to me......... slackness on this law-wrangling.
The wheels of this are seeming to turn very wobbly for Terri this morning. God help her.
Maybe it's just me. But It's going to take an excellent attorney to save Terri now.
I just am not convinced in the one doing the lawyering at this point.
An attorney that's savvy and as conniving as felos, would be pushing ALL the information in the backdoor and around the sides, because this is "life and death and and crime" situation rolled into one.........Wouldn't they???
Every time I see one of the Drs., attorneys or a judge on TV or radio get rattled on the "new" info they are hearing. It makes me think some one is not doing their job.
I am praying for Terri and believing for her, even after this lawyer debacle.
Also prepared for anything. Sadly.
But also being ready to give thanks, if she goes to be with the Lord.
I hope all of you got some needed rest.
