Absolutely they could refuse. Just let the 3 judge panel ruling from Atlanta stand, without comment. In fact, I believe Scalia said something recently about the Federal Government should not be involoved in these personal, family, tragic matters. Don't know if he was thinking of this case or not. But he is clueless in that the judiciary is making law on these matters as we speak, and people are being cruelly tortured and killed. What ever happened to "live, liberty and the pursuit of happiness", Mr Scalia? That's not a Federal issue??
