JURY PROBES EX-BILL AIDE'S 'SOCKS DOCS'-FOX News has confirmed the grand jury investigation

WASHINGTON — The criminal probe into why former Bill Clinton aide Sandy Berger illegally sneaked top-secret documents out of the National Archives — possibly in his socks — has heated up and is now before a federal grand jury, The Post has learned.

The "Socks Docs" probe forced Berger, who was President Clinton's national security adviser, to step down as Democrat John Kerry's top foreign-policy adviser last summer.

"It may have been off the front pages, but the investigation has been active," said a source with knowledge of the probe.

"[Berger] has been interviewed several times by federal agents — FBI and prosecutors."

Berger admits removing 40 to 50 top-secret documents from the archives, but claims it was an "honest mistake" made while he vetted documents for the 9/11 commission's probe into the Twin Towers attacks.

Berger has also acknowledged that he destroyed some documents — he says by accident.

The probe was touched off last spring when stunned archives staffers reported seeing Berger sneak classified documents out of a top-secret reading room in his pants and socks while vetting Clinton-era items for the commission.

They then ran a sting operation in which they coded some documents and confirmed they were missing when Berger left.

The documents were classified Code Word, the highest security classification, above Top Secret.

The commission report makes clear that Berger had a habit of writing candid notes in the margin of memos, sometimes flatly rejecting plans for action.

He nixed a plan to capture Osama bin Laden with one word: "No."

Burglar prolly thinks he's immune from prosecution because if he goes to trial, the contents of those documents will come out - something the CIA/DIA would never allow to happen.

It's not a nice feeling to know that everywhere one goes, where ever in the world for the rest of his life, there's a CIA or FBI agent following him.

I don't think he did this to cover the Clinton's behinds. I think he took the docs to cover his own behind, and there's a good probability he has been working for a foreign government.

I'm with you about re-instituting proper voting identification and strict procedures. For the next election all citizens should be required to show up at THEIR LOCAL PRECINCT and show proof of citizenship to re-enroll as a voter. No other agency or group should be allowed to register a voter. No other voting place other than the local precinct shall accept a vote, unless an absentee vote is requested 1 month in advanve. All votes should be cast on JUST VOTING DAY.

I watched that O'Reilly interview with Rather, and remember thinking that O'Reilly should have told him that by those standards, Rather must think that President Nixon was an honest man, as well.

And what about the memos out of Rochefeller's office? I don't want them to forget this too!

Let's don't let even one of these scandals get by!

The dems have a way of falling through the cracks when under scrutiny.

There were many federal laws broken in hiring people for CID(civil srvice) Marcea the agent(CID) who obtained the FBI folders for shillary was over the age limit of (37) to be hired for that 1811 position(CID)civil service Berger needs to made an example of and incarcerated for many years. Klintoon needs to pay dearly for his crimes against those poor women and the American people. If the line is not drawn in the sand, this type of clandestine government power abuse will be raise it's serpent head once again. One lawyer is Lanny Breuer, a former WH counsel for guess who, brought in during the campaign finance scandal hearings in 1997.

Anybody got any updates in the Joe Wilson/Valerie Plame case? Last thing I knew some reporters were refusing to divulge their sources (probably because it would implicate the Wilson-Plames, or some other Dem). Anything new on this one?

I have posted for months when coming across posts complaining that Berger got away with it, that he did NOT and I commented that the investigators want answers to the very questions you are posing.

I see I was correct--the investigation does in fact continue and I'll say it obviously is putting pressure on him to divulge the answers to those questions. Whether that effort will be successful remains to be seen, but I have long thought it absurd to think his case was dropped. Of course it never was.

Considering the sequence of events, I'm guessing the missing documents are about either Clarke or Wilson....or both. The fact that documents are missing doesn't just mean a shredder, it means burning....but I'd guess there is an "insurance policy" (cache) someplace.

Appellate court to issue ruling any day on whether the contempt citations for Judith Miller and Matthew Cooper are upheld. I've been keeping my eye out for it.
