Daschle flames out in his bogus lawsuit

Posted on 11/01/2004 7:55:51 PM PST by eddiebear

November 01, 2004 Live Report From Courtroom A Mr. Jordan was just testifying at the hearing in Daschle's lawsuit to stop poll watching. He worked for Howard Dean in Iowa. He said that poll watchers would "roll their eyes" and make a "negative face" at times and that, in his opinion, this constituted "intimidation" of voters. See SDP for a look at the complaint.

UPDATE: Another report on Daschle's first witness, the Howard Dean worker. He's a lawyer from Virginia who works for Lexis-Nexis and has been in South Dakot for 48 hours. He testified to "note-taking" and "faces" being made. He said nothing was said to voters and nobody was disenfranchised. They are taking a short break before the next witness. Lawyers in the courtroom think this is an absurd joke. SDP calls it "The Death Rattle of Daschle's Political Career."

UPDATE: SDP has some more information on the judge, including this comment from Daschle at the American TRIAL LAWYERS Association convention:

First, I got my start in politics thanks to lawyers... rather, one lawyer in particular. In 1978, I won my first election to the House by 14 votes. Don’t laugh, in South Dakota, that’s 60 percent of the vote. Apparently undaunted by that landslide of support, my opponent sued to contest the election. I was fortunate to be represented by a great lawyer and a dear friend, Larry Piersol. It took one year and 21 days, but here I am 25 years later. UPDATE: Daschle rests. Cancels other witness because first one got destroyed. Dismissal requested by Republicans. Dismissal denied.

Circuit Courts have a Motions Judge who serves the same function that the assigned Justice of the SC. On emergency relief, one judge can stay the order of the trial court, if it comes.

"There is one small consolation in all of this. Thanks to the internet, and of course to FreeRepublic, this stunt is already known NATION WIDE! They can run, but they can't hide."

It's delicious, isn't it?

Thanks Jim Rob for FR!!!

< rhetorical questions> If you have to show ID to

cash a check
buy beer
buy cigarettes
rent a video

How is it intimidation to show ID when you vote?

< /rhetorical questions>

Historically, axing for an ID for cashing a check, buying a beer, buying tobacco, or renting a video wasn't generally limited to customers of color. Axing for an ID or giving (check the web for examples) a voter comprehension test, was. It was a Democrat thing.

The great irony here is that in the last election, Thune was cheated by vote fraud, and it was ok with the Dems. Daschle may realize, too late, that it may have been better for him to have sacrificed the position in the 2002 election, becuse by 2004 the cheating tactics would be known and he himself would be prevented from using those same tactics. Strategery - Daschle lacks it. And like all good RATS, he runs to the courts to tell them to make sure he is elected.

This whole episode smells like what is about to come. Beware the avalanche tomorrow evening and Wednesday morning, folks. These chickens are coming home to roost, it ain't gonna be pretty. Our Electoral system is prepared to be totally hijacked by litigation from rat attorneys. Stay Strong.

Thanks for your support.

A prayer wouldn't hurt either.

We're needing a bunch of help.

What a wussie. If this isn't a metaphor for the Democrat party's response to every adversity, I don't know what is. I hope he gets his ass kicked up around his neck.

I hope Thune stomps a mudhole in Dasholes' chest and kicks him to the curb.

Texas Eagle asked this on another related thread: (worth re-posting, imo)

"On the face of it, this should be an easy case for the Republican lawyers to argue: "Your Honor, why is it okay to have UN election monitors but not American?"

Still no decision..that I can see. I cannot imagine the judge can rule for Daschle on this. OTOH I cannot imagine why he didn't recuse himself. What a humiliating way for this weasel to go down.

From daschlevthune.typepad.com:

UPDATE: From the other end of the state, Wes Roth reports there will soon be a protest at the Daschle campaign office in Rapid City.

UPDATE: Daschle lawyer asks for remedy of not disproportionately sending lawyers to Indian country vs. non-Indian areas. Judge asks if he has any authority in case law for such a broad remedy. Daschle lawyer cited no cases.

UPDATE: The judge raises the issue of live reports coming from the courtroom and ending up on some website. What an outrage!
