November 01, 2004 Live Report From Courtroom A Mr. Jordan was just testifying at the hearing in Daschle's lawsuit to stop poll watching. He worked for Howard Dean in Iowa. He said that poll watchers would "roll their eyes" and make a "negative face" at times and that, in his opinion, this constituted "intimidation" of voters. See SDP for a look at the complaint.
UPDATE: Another report on Daschle's first witness, the Howard Dean worker. He's a lawyer from Virginia who works for Lexis-Nexis and has been in South Dakot for 48 hours. He testified to "note-taking" and "faces" being made. He said nothing was said to voters and nobody was disenfranchised. They are taking a short break before the next witness. Lawyers in the courtroom think this is an absurd joke. SDP calls it "The Death Rattle of Daschle's Political Career."
UPDATE: SDP has some more information on the judge, including this comment from Daschle at the American TRIAL LAWYERS Association convention:
First, I got my start in politics thanks to lawyers... rather, one lawyer in particular. In 1978, I won my first election to the House by 14 votes. Dont laugh, in South Dakota, thats 60 percent of the vote. Apparently undaunted by that landslide of support, my opponent sued to contest the election. I was fortunate to be represented by a great lawyer and a dear friend, Larry Piersol. It took one year and 21 days, but here I am 25 years later. UPDATE: Daschle rests. Cancels other witness because first one got destroyed. Dismissal requested by Republicans. Dismissal denied.

This smells worse than day old baby diapers. A Rat judge who helped get Daschle elected in the first place is now keeping him from being hauled kicking and screaming off the national stage. Hope its only a temporary delay, Tom.
After Daschle loses, we need to move to impeach this judge perhaps.
There is one small consolation in all of this. Thanks to the internet, and of course to FreeRepublic, this stunt is already known NATION WIDE! They can run, but they can't hide.
I am a Republican poll watcher tomorrow in South Dakota....and if this keeps up I will probably develop a facial tic. But....no one will keep me from my duty in the morning.
I, and many like me, have busted our butts trying to get Thune elected. I promise......we shall not give up. This is just too damn important.
Daschle just showed his colors tonight. And they are all yellow. This will hurt him.

Dear people of South Dakota, Please, when coming away from the polls tomorrow, Roll your eyes and make "negative faces". Show it to the reporters and cameramen.
Bury Daschle's political career in a mockery of his own contempt for the law!
You know, if you poll watchers covered your heads in white hoods to hide your facial features, they'd complain about that too!

I've been a Minnesotan for almost 20 years now. My folks still live in S.F. and I get back there once a month.
I have a feeling, depending on the outcome of this situation, things will die down if Thune wins (Another silent prayer!).

I would be shocked if they don't ask for a recusal!

LOL, you are so right ...he's all smiles in SD, but deeeply sadened in DC.
