The following excerpt was transcribed by me from my videotape of the 5 minute segment on Fox News Channel this morning entitled, "Bracing For Battle". The segment began at 9:44 AM and ended at 9:49 AM Eastern.
Guests: Richard Goodstein, Democrat strategist and former advisor to the 2000 Gore/Lieberman Campaign
Ben Ginsberg, Election law expert, and national counsel for the Bush/Cheney 2004 Campaign. (He was also counsel to Bush/Cheney during the 2000 election re-count)
Bottom line excerpt:
Ben Ginsberg: "The essential point is, did Sandy Berger, who is one of John Kerry's top advisors, get those documents - those classified documents that he was stuffing down his pants in the National Archives - to the Kerry Campaign for their benefit? And that's an essential question that needs to be answered by the Kerry Campaign. Did they benefit from documents and information they should not have had?"

GOP Moves to Declassify Clarke Testimony (Perjury Trap ?)

Top Republicans in Congress sought Friday to declassify two-year-old testimony by former White House aide Richard Clarke, suggesting he may have lied this week when he faulted President Bush (news - web sites)'s handling of the war on terror.
"Mr. Clarke has told two entirely different stories under oath," Senate Majority Leader Bill Frist said in a speech on the Senate floor.
The Tennessee Republican said he hopes Clarke's testimony in July 2002 before the House and Senate intelligence committees can be declassified. Then, he said, it can be compared with the account the former aide provided in his nationally televised appearance Wednesday before the bipartisan commission investigating the Sept. 11, 2001, attacks.

Federal probe targets Clinton's national security adviser
From John King
CNN
WASHINGTON (CNN) -- Samuel Berger, former President Clinton's national security adviser, is under federal criminal investigation for allegedly removing classified documents and handwritten notes from a National Archives screening room during preparations for his testimony before the 9/11 commission.
Sources familiar with the investigation confirmed it to CNN on Monday.
The sources told CNN the investigation began last October, after Berger spent roughly 30 hours over three or four days reviewing what one said was "tens of thousands of pages" of Clinton administration documents to comply with a request from the 9/11 commission.
Berger was designated as the official from the Clinton administration who would review documents relevant to commission inquiries. He was also a witness at the 9/11 commission hearings and reviewed records to prepare for his personal testimony.
The Associated Press first reported the story Monday.
In a statement, Berger acknowledged that he removed his handwritten notes without first having them reviewed for sensitive information, and he also said he "inadvertently" removed some of the classified documents he had reviewed during his time at the Archives.
National Archives' policy requires that if someone reviews classified documents and wants to take their handwritten notes with them, those notes must first be cleared by archivists.
In his statement, Berger said that "when I was informed by the Archives there were documents missing, I immediately returned everything I had, except for a few documents that apparently I had accidentally discarded."
"I deeply regret the sloppiness involved, but I had no intention of withholding documents from the commission, and to the contrary, to my knowledge, every document requested by the commission from the Clinton administration was produced," he said.
A Berger associate, who spoke on condition of anonymity, said the FBI served warrants and searched both Berger's home and office earlier this year as part of the investigation.
A government official familiar with the investigation said that some documents are still missing.
Among the documents Berger says he inadvertently took, the sources confirmed, were drafts of a Clinton administration "after action" report on efforts to thwart al Qaeda around the time of the millennium.
Archives officials told investigators that at least one draft of that report is still missing.
Officials close to Berger said it was ludicrous to suggest that he was trying to hide damaging information from the 9/11 commission.
They said the drafts were written by Clinton counterterrorism czar Richard Clarke and had been changed somewhat, as is customary, as the drafts were circulated among relevant agencies and officials.
But the sources close to Berger said there were other copies of the drafts, that the commission had the final version of the report and that Clarke had said there were not significant changes during the drafting process.
The sources said the FBI had contacted Berger several months ago and that he hired Lanny Breuer, who has since been in contact with prosecutors.
Berger has stressed his willingness to cooperate, but investigators have not asked to speak directly with him as yet, the sources said.
Asked if it unusual that Berger has not yet been interviewed, the government official familiar with the investigation responded that investigators would do so once they are satisfied they have the evidence they need.
Sources close to Berger said they did not believe there was a grand jury impaneled as part of the investigation and that to the best of their knowledge, Clarke and other Clinton administration officials who have knowledge of the documents in question -- and specifically about any changes made in the drafting process of the millennium report -- have not been questioned.
One of these sources questioned the timing of the leak, three days before the public release of the 9/11 commission report.
"There is a story here, and Sandy concedes he made an inadvertent mistake," one source, a former Clinton administration colleague, said. "But this has been kept confidential for months. So why now?"
A Justice Department spokesman had no comment when asked about the Berger probe.
Berger currently serves as an informal adviser to the campaign of presumptive Democratic presidential nominee Sen. John Kerry.
This is Clinton sabotaging and arkanciding and some nitwit under the clintoons will have to pay for their mistakes!
Ruth Bader Ginsberg's stare pares through my soul like a shark with laser beams on its head.

Of course, they COULD run it to the hilt, get him off the ticket, and have Hitlery waiting in the wings.
Quite frankly, I would MUCH prefer a BUSH-HITLERY matchup.
Of course, they COULD run it to the hilt, get him off the ticket, and have Hitlery waiting in the wings.
It will not happen, the Soxgate Bergular worked for the Clintoons. He was only and an advisor to al Queery.
This will probably neutralize the fabulous Clintoons for this election year and who knows how far out.
The second question should be:
Upon your discovery of the 'accident', Mr. Berger; why did you not notify proper authorities and return the classified papers immediately?
At the least; he had to know that something terrible had happened when he took his socks off to go to bed that night. . .
Don't know what happened with that story re Kerry; but I thought that was a long time ago; in any event; it is not just Kerry who is willing to go beyond the pale for self-serving reasons.
Am sure Hillary pulls up the stolen FBI files; often; just to check her lists and make sure everyone she needs to make 'nice'; is doing just that.
Have said it before; will say it again; NO Liberal Democrat should ever be allowed to come into contact with sensitive information. And that includes right down to working in the mail room of any Government office.
Cannot trust them; EVER.
I just read on another thread that Berger briefed some reporters in Feb. about airline security measures that Kerry favored. It is suggested that some of these recommendations were in the classified documents.
So...who else read the documents prior to Bergler's inadvertently stealing and then destroying them? Anyone besides the Clintons and Richard Clarke?
The obvious motive is for this "hot shot security maven" to protect his own reputation as a former National Security Advisor, and protect his future career in a Kerry or second Clinton administration.
Beyond that, however...given that he's currently a Kerry advisor...there are numerous plausible angles that need to be investigated. Is he protecting the Clinton legacy and covering up the disastrous results of the Reno/Gorelick "wall" policy in order to maintain the credibility (ha!) of the Sept. 11 commission's "findings" and place "blame" on Bush, in hopes of getting Kerry elected?
Just because the documents were destroyed doesn't mean they were of no value to Kerry, either...what was Kerry doing back in '99? What did he know about the "Millenium Plot", and more importantly, what actions did he take in the Senate that could be related to the content of the "lost" documents?
Was it more than "the scream" that decimated Dean's campaign? When did the great Kerry come-back start, and what started it?
What does Kerry know about content of the classified documents? about Bergler? When did he know it, and how did he use the information?
What does Bergler really think of the Clintons?
One thing is for sure...one does not "inadvertantly" stuff papers in several different pockets (or socks, which I do believe!) just "absent-mindedly", or walk out of a secure site with a leather folder you didn't walk in with...or conversely, if Bergler does, he had no business being the National Security Advisor as recently as three years ago.
And if Kerry doesn't dump him quick, it means Kerry's not concerned about either Bergler's conduct, or the effect on his campaign of associating with an obviously dishonest if not criminal person...why not?!
IMHO, this will "have legs", with or without "sox"!
Well, being more specific here. . .'to think that he would go to the trouble of not just 'taking them' but rather. . .stuffing them in his socks. . .and his pants yet; and then mistakenly discarding them; boggles the imagination; not with the 'story itself'; but rather the insulting arrogance of even offering such a stupid defence.
I mean; if it was an accident, why didn't he report it; when he took his socks off. . .
Perhaps Berger should be charged with 'failure to report and accident' and surely leaving the scene; if he noticed his stuffed socks before exiting the building.
That sounds like a 'red herring' that has been thrown out to confuse the issue of what really has happened here.
Makes it sound like, Kerry might have been on top of things. . .what with making 'security' proposals for the airlines. . .just does not make too much sense to me; going with that line.
No reason for Kerry to look better than Clinton; and that is what these papers supposedly have to do with/Clinton Admin et al/Berger etc; their (non)-response to terror and no doubt, their NOT sharing the info with Bush.
We knew Clinton was determined to leave this presidency with as much damage as possible for GW to come into. . .as did even his minions destroy and trash the WH before Bush's arrival.
Clinton's crimes go beyond one's worst expectations; but not beyond one's worst fears.
Documents detailed deficiencies in preventing terrorist attacks at airports, port facilities and other public services....John F'n "flip-flop fop" Kerry would use to beat up on Bush.
Note also that John F'n "flip-flop fop" Kerry ignored the lack of security at Boston Logan airport some years ago.
Truth is; it cannot be 'inadvertant'. Period.
And if he claims 'accidental'; he should be charged with leaving the scene; and failure to report the 'accident' as soon as he realized it.
I mean; I am sure, that Berger does not wear his shoes to bed. Nor his pants; for that matter.
And I believe; it was Berger that was notified of the accident; not Berger reporting it.
Thanks. . .
Incredible; obviously not done her homework; good to e-mail them and suggest they learn the facts of this story before confusing their viewers. . .(think I will ;^))
