Florida Judge Makes Up His Own Laws - Jun 29, 2002 It seems that Judge Harry M. Rapkin of the 12th Judicial Circuit Court in Florida has no problems with ordering land to be sold and stolen from the Christ's Lawful Assembly at Sarasota, a non-incorporated fellowship in Christ Jesus.

In the past month, the appointed steward for the assembly has been arrested on false charges, the local ecclesia's property was "sold to the highest bidder," and now the Sarasota County Sheriff has posted an Eviction Notice on the land. Despite the fact that the County Clerk has on Record proof of these payments in full, the "Court" has refused to acknowledge the Lawful Assembly any rights to their land.

Judges have the right and the authority to overturn a jury's decision if he or she feels the jury misinterpreted the facts, or if the jury disregarded the facts. It's rare, but it does happen. Nad it happens on both civil and criminal cases. What's more common, though, is when a judge overrules a jury's award of damages in a civil trial, by either adding (an additur) to the award or reducing (a remittitur) it.

I am sure he was given a drug test when apprehended. Even if it comes up positive I dont see how he could successfully use the insanity defense and he would have to find a top notch lawyer to do so. A public defender is not going to save this guy with that video tape and no jury is going to let him get insane plea. The big guns may not come in until the DP appeals. Then in that situation, the judge can be unseated. But that is not always the case; we don't have the facts. I have also watched judges limit the defense's ability to defend.

And there have been activist juries, also. I just don't think that is a healthy place to put our anger for this situation.

Where I would be more upset is this guy has a history of how many drug offenses?

I am not even upset that the judge in December didn't find him in violation of his parole; the judge probably thought he was having compassion on someone who was having employment problems. We all want to give someone a second chance when they are down... and those were drug charges, not abduction/assault/murder charges.

We are slipping toward a dictatorship of judges who make decisions and overturn laws at their whim (or the size of the bribe).

This monster should have been returned to jail when he violated the terms of his probation.

I agree on his history. Some how the ball was dropped there. But, minus the abduction years before, on a woman, not a little girl, it doesn't look like he had a history that would have suggested this behavior.

He got a public defender which he is entitled to. When arrested he surely requested one. A cretin like him has no funds for a good lawyer. A public defender has no choice but to defend this scum.
