It sounds as if the prosecutor is in bind, as the people he sited (State Attorney/Bar Association) have now said they never gave him permission to release those records. Somebody's lying.

I would absolutely hate to be on the opposite end of Mark Levin in a lawsuit. The prosecutors are going to get their asses kicked (and even though I'm also a prosecutor, I say, "good"!).

Limbaugh Attorney Calls for Investigation of Prosecutor Miami, FL – January 28, 2004 -- Roy Black, Rush Limbaugh’s attorney, issued the following statement today regarding the January 28 letter from Pat Gleason, General Counsel to Florida Attorney General Charlie Crist, revealing that Palm Beach County State Attorney Barry Krischer’s office misrepresented what she said about confidential correspondence in Mr. Limbaugh’s case: “This letter leaves no doubt that State Attorney Barry Krischer is conducting a deliberate smear campaign in the media in an effort to trash Rush Limbaugh’s reputation. The AG’s General Counsel Pat Gleason, whom Mr. Krischer’s office has publicly described as ‘the AG’s most knowledgeable person on the Public Records Law,’ states in her letter that in trying to justify the release of confidential correspondence in Mr. Limbaugh’s case, Mr. Krischer’s office publicly misrepresented what she advised by omitting ‘critical parts of our discussion.’ “The improper release to the media of confidential correspondence was a grave injustice to my client. Something tells me that because this is Rush Limbaugh vs. a Democrat AG, the result will be that no charges will be filed against Limbaugh and case closed, with no ethics action against the AG either, because he's a Democrat and the negative press would hurt them (and the fact that there are no ethics when you're a Democrat). Limbaugh's power and influence will save him, but the AG will be free to terrorize the less-connected in the future.

there are email adresses, Not that you heard it here.
for a decision on whether it should go to committee.


IF it is a hot potato he/she may just leave it to the randomly assigned committee to decide if there is or is not probable cause.

The SA will have time to respond. (if they ask for an extension, it is not unusual and they are freely given) Then LLF will have time to respond.

The committee is made up of both lawyers and non-lawyers. All volunteers. No part will be made public from the part of the Bar until probable cause has been found. At this stage, the preliminaries are considered confidential.

Hahaha...!
It was stupid for this mediocre prosecutor to play games like this with Roy Black. Really, really stupid. And now there will be consequences. Enter Mark Levin and Landmark. I give it about a week before the Palm Beach County State Attorney decides that "it is in everyone's best interest to put this matter behind us."

Does anyone have the actual complaint? If the actual complain is not specific enough. (even citing a few rules) There may be a weaseling.
