It sounds as if the prosecutor is in bind, as the people he sited (State Attorney/Bar Association) have now said they never gave him permission to release those records. Somebody's lying.

I would absolutely hate to be on the opposite end of Mark Levin in a lawsuit. The prosecutors are going to get their asses kicked (and even though I'm also a prosecutor, I say, "good"!).

Limbaugh Attorney Calls for Investigation of Prosecutor Miami, FL January 28, 2004 -- Roy Black, Rush Limbaughs attorney, issued the following statement today regarding the January 28 letter from Pat Gleason, General Counsel to Florida Attorney General Charlie Crist, revealing that Palm Beach County State Attorney Barry Krischers office misrepresented what she said about confidential correspondence in Mr. Limbaughs case: This letter leaves no doubt that State Attorney Barry Krischer is conducting a deliberate smear campaign in the media in an effort to trash Rush Limbaughs reputation. The AGs General Counsel Pat Gleason, whom Mr. Krischers office has publicly described as the AGs most knowledgeable person on the Public Records Law, states in her letter that in trying to justify the release of confidential correspondence in Mr. Limbaughs case, Mr. Krischers office publicly misrepresented what she advised by omitting critical parts of our discussion. The improper release to the media of confidential correspondence was a grave injustice to my client. But even more grave is the revelation that a memo initialed by Mr. Krischer himself tried to mislead the public about the positions and policies of some of the states most senior legal officials. This sad news comes on the heels of a similar disclosure by the Florida Bar, which contradicted Mr. Krischers assertion that its Ethics Department had advised him to release the Limbaugh correspondence. What more needs to happen before a higher authority decides to investigate the Palm Beach County State Attorneys Office for inappropriately conducting what is obviously an orchestrated smear campaign against Rush Limbaugh?

Somebody's lying. That one's going to be hard to figgure out. Let's see.... the prosecuter is in Palm Beach county, is a democrat, and is still a member of the New York bar. Geez, this is going to be tough! :-)

Levin concluded, This investigation is so tainted by politics and personal ambition, it has become a clear miscarriage of justice. From the earlier leaks about nonexistent drug rings and money laundering, to unprecedented search warrants and abuse of confidential medical records, no objective person would call this anything but character assassination.
What bothers me is the attitude by some conservative types that it is okay for state officials to assassinate Rush Limbaugh's character even if it means lying about him, smearing him and his associates---because he and they "deserve" it for not being good enough Republican conservatives.
Something is wrong with our side if this is what we condone.
