AL FRANKEN KNOCKS DOWN DEAN HECKLER

Wise-cracking funnyman Al Franken yesterday body-slammed a demonstrator to the ground after the man tried to shout down Gov. Howard Dean. The tussle left Franken's trademark thick-rim glasses broken, but he said he was not injured.

Franken - who seemed in a state of shock and out of breath after the incident - was helped back to his feet by several people who watched the tussle. Police arrived soon after.

Thanks for the info.

Beck said he wished he'd had a tape recorder because the guy was really acting like a jerk.

Instead, Beck walked up to him and asked if he could have someone take his picture with Franken (because he said that would at least prove he had been on the same flight.)

As a former High School wrestler and Wrestling coach I can say with 100% conviction that a bear hug is not applied from behind.

Sounds like Al got a little horny and jumped on the first thing he saw.

I would also like to talk to some of Al's wrestling teammates. I'm sure he was the kid crying in the middle of the mat with his underwear pulled over his head from the atomic wedgie he just got.

Thanks, what you say makes good sense. I was just speculating, I guess, because I really don't hear of people being prosecuted for Assault & Battery these days, at least where I live. And jargon often changes while the public continues to use the old (and often less obfuscating) term.

After tearing in to a back room without his specs, Franken emerged a bit red-faced and with bright yellow tape holding his glasses together after the event.

Does this sound to anyone else like Larouche dude belted him one? Maybe that's why he didn't get arrested.

His glasses probably just fell off. If the other guy had slugged him, there would have been more damage than just busted glasses. Also, if the guy had just hit him he wouldn't have been able to jump him from behind.

Given Mr. Franken's avoirdupois, I think we could make a pretty good case for aggravated assault if he FELL on the guy - he's heavy enough to constitute an "object, device, or instrument which, when used offensively against a person, is likely to or actually does result in serious bodily injury" -- all by himself.

I wonder if this was a set up... something to promote Franken and get his name in the news. Why wouldn't the victim have him charged with assault?

The way he responded after the incident, I think you are on to something.

Is there anyway we can find this guy he knocked down and have him press charges? This is outrageous. Can you imagine if, let's say, Dennis Miller attacked an Anti-Bush demonstrator? It would be a full hour on NIGHTLINE. (By the way, I always use that as an example...but is that thing still on TV? I Haven't seen it for probably 10 years!

There was someone else on the Fox staff that he went after at some public affair too. I'm thinking Shepherd Smith, but I don't think it was. I think it was one of the lesser reporters...not one with a show, but who it was escapes me at the moment. I remember him saying it took a lot of restrannt for him not to deck Franken.

Actually, I believe the correct statement is that it is certainly "BATTERY" but not necessarily "ASSAULT".

Once upon a time, "Assault" was defined as putting a person in fear of a "Battery" which means that the victim would have to see it coming. If Frankin attacked from the guy's rear, then not an "Assault" in the pure sense of the word.

"Battery", or physically harming a person would be clearly present as Frankin did a Body Slam.

Of course, the police file charges which are inconsistent with the definitions all the time. O well, it doesn't make a lot of difference, as long as the victim sues Frankin's butt off.
