Actually, I believe the correct statement is that it is certainly "BATTERY" but not necessarily "ASSAULT".
Once upon a time, "Assault" was defined as putting a person in fear of a "Battery" which means that the victim would have to see it coming. If Frankin attacked from the guy's rear, then not an "Assault" in the pure sense of the word.
"Battery", or physically harming a person would be clearly present as Frankin did a Body Slam.
Of course, the police file charges which are inconsistent with the definitions all the time. O well, it doesn't make a lot of difference, as long as the victim sues Frankin's butt off.

How is there only ONE news story posted on google about this at the NYPost? If Rush had bodyslammed a Tancredo supporter at a Bush event you think there would be ONE story about it?
