Farmer's house to be destroyed in a matter of hours.

Well, Free Republic can't help.

The farmer is at his gate with it locked. The police are there and now the county is going to have to get a court order to cut his lock. It is only a matter of hours before they tear down his house! Aren't we proud of our BIG GOVERNMENT saving us from ourselves!

His house might flood. So the government will destroy it so it can't flood!

Sad day on Bethel Island, CA in Contra Costa County.

Here is the police car, the police filling out some kind of papers. You can just see the farmer. He has only one eye and has a patch over his right eye.

No, there is more to this story, with all due respect to the poster. I don't buy any of this.

There is. You are right (online). The farmer apparenly knew he couldn't live in the mobile home on the property and is. They're just enforcing rules as he knew it at the time he started violating them.

A local "conservation" group took them to court and got a judgement against them and the county razed their house. Who hasn't heard of a farmhouse on a farm!

If the deed restrictions said no residential development, how is the group or county wrong for enforcing a written contract? The problem lies with whoever was bribed by the conservation group to grant the conservation easement on his land.

No one is living in the house. About 10 times a year, the farmer will stay over night in the building. It is right across the street from me. I even signed an affidavit stating that no one was living there.

I think the county wants the building removed be cause some one "could" live there.

Your original post was at 11 am, now it's after 3.

What's happening? Was he able to keep them out? Did they already destroy his property?

3:20PM 11/25/3

There is no one at the location now. Everyone left about 11:00 am this morning. The county guys went to get a court order to cut the lock. The police left. Preston Avery the farmer has left. I don't think there will be anymore activity today.

I have been trying to answer the questions that people have on this thread. Preston Avery, the farmer, owns the property and the house which is/was a mobile home, but is on a foundation with built on awnings and a garage. Mr. Preston is not a crook and has tried to comply with all the rules. They told him that he had to put the trailer up on pilling and they gave him a week to do it. It would cost about $40K and take months to get a contractor to do that. But no one lives there so Mr. Avery believes it is not necessary.

As an aside, they would probably make him install an elevator so that disabled people in wheel chairs could also have access to the house if it were on pillings.

I will post another update when something new happens.

Thanks for the update.

I think your friend should appeal to Gov. Schwarzenegger -- have him call AND fax.

I think the point here is that the government is run amok, is about to destroy the man's own property on his own land. That sounds like communism to me and will sounds the same for Arnold.

I think he may actually be able to help.

You can thank the enviro-wackos for this...pretty soon, everything in the floodplain will be claimed by them, they already have claimed the praries, woodlands, forests for the Chill'ren, bambi and Peter-cotton tails.

It didn't say no residential development. It said that the land was to be used as a farm. It's fairly common for a farmer to have a house for himself on his farmland.
