Freepers, I love the Gulf side of Florida but THEY JUST DON'T LIKE FOLKS OVER HERE...

I've already contacted Governor Bush.

I've contacted a Tampa Tribune reporter who is going to read the article and possibly seek an opinion from from Fla. AG Crist.

If you have a minute to write a letter to the editor of the St. Pete Times, please feel free if YOU ARE OUTRAGED AGAIN AT HOW FLORIDIANS ARE TREATED.

Or, feel free to contact Mr. Fleetwood of the Division of Land Sales & Condominiums. He seems like he's been a figurehead for too long and made a lame statement at best.

And, my favorite option is to contact the Summertree Development and/or Pointe West Condominiums to quiz them on the U.S. Constitution. APPARENTLY, THEY'VE NEVER HEARD OF IT...

Fregards,

Florida - abusing the disabled and abusing the elderly, one person at a time.

I'm trying to help!!!! Please help me...

If someone can get the contact numbers for The Division of Land Sales & for this lovely development, thanks in advance.

I may be up for a "protest" at this condo complex if I'm not an army of one. FV

This sounds ridiculous, but I don't have much sympathy for this guy. Anyone who buys a home in a building managed by an association and still thinks they own anything is naive.

All of these associations are essentially private governments. This is bad, it is government without all of the constitutional restrictions of a normal government.

IMO you are crazy to buy property under the jurisdiction of one of these pseudo-governments.

It's the condo associations. They're nothing but trouble. Can also happen in neighborhood associations if there are deed restrictions on your property. The law, as it stands, is on their side, the issue should be "buyer beware" and "full disclosure" of all the idiotic rules before you purchase.

My in-laws used to live in one of the Senior Adult Condo communities.

Nothing but a bunch of sour pusses out to stifle individuality.

I live in this area and have noticed that Homeowners Associations that finally become controlled by the owners tend to move towards totalitarianism pretty fast. A few power-hungry retirees with too much time on their hands take it upon themselves to mold the community in their own image (wrinkled and tight). Lawsuits are constantly being filed by owners in these communities against the HOA's because of these "rulings" and their "interpretations".

I have moved out of one such community and prefer living in ones where the developer is still in control I am in such a one now, but am looking to move again into a less controlled environment (Freeper-Friendly) by the time it gets turned over to the owners. Yeehaw!

This "social gathering" rule was enacted without the consent of the condo owners?
It was imposed upon them by someone on the outside?

Or was it done with their consent?

How dare some 89 year old man, have the audacity not to be bed-ridden or chair bound? Why older folks aren't supposed to go against the grain and be a happy, productive part of any commmunity, especially a controlled environment like this one!

By golly, standing in your frontyard at 89 is disgusting to the younger neighbors in their 60's!

We'll have none of that anymore. Next thing you know, they'll be drinking iced tea outdoors too!

Sheesh, some of these HOA's have their HUA. (Head Up A$$).

718.123 Right of [Condo] owners to peaceably assemble.--

(1) All common elements, common areas, and recreational facilities serving any condominium shall be available to unit owners in the condominium or condominiums served thereby and their invited guests for the use intended for such common elements, common areas, and recreational facilities, subject to the provisions of s. 718.106(4). The entity or entities responsible for the operation of the common elements, common areas, and recreational facilities may adopt reasonable rules and regulations pertaining to the use of such common elements, common areas, and recreational facilities. Condominium is just a fancy word for "apartment". Civilian barracks, if you will.

My only advise to to avoid condominiums, apartments, home owners associations, etc etc......

Um, Mr. Pemburn, it IS a Communist camp, and you joined voluntarily.

Last year, my condo association issued the royal decree that residents were forbidden to have real Christmas trees, and had to get artificial ones, or suffer a fine.

Something about natural trees being a fire hazard.

It was the last straw, and we're finally moving out of that Pit of Nazis and Snakes next week.

Unfortunately, the U.S. Constitution does not apply to these non-governmental governments, to the best of my knowledge. They do have to abide by certain governance rules, but Home Owner Associations are free to restrict many liberties. And in fact they often violate even the governance rules.

My local paper has a real-estate law column. At least half the questions deal with HOA boards acting without due process. There is something about serving on these small quasi-governmental bodies that makes people into little tyrants.

Hey, FV, these condo board members are up for election when? This disgruntled and lively condo crowd won't be re-electing this board.

The busybody board members would be better off on the east coast, maybe West Palm Beach. I hear there's a Dem. tyrant reigning over a Senior complex on the Atlantic side ~ Seniors intimidated into voting Democrat, enjoying the attention they receive from the press and wealthy and powerful Dem. candidates who stop in to acquire the tyrant's seal of approval.
