Conservative, Liberal Law Groups Face Off by Steve Jordahl, correspondent
SUMMARY: A legal battle over the role of government in decisions about life and death is under way in Florida.
The American Civil Liberties Union (ACLU) and the American Center for Law and Justice (ACLJ) -- two of the most influential legal societies of their respective ideologies -- will oppose one another in court to determine whether the state of Florida can order Terri Schiavo to be fed and given water.
The case stems from the Florida Legislature's passage last week of a law allowing Gov. Jeb Bush to stop the court-ordered starvation and dehydration of Schiavo, a 39-year-old disabled woman.
The ACLU quickly filed a suit challenging "Terri's Law" as unconstitutional.
"This is a dangerous abuse of power by the governor and the Florida lawmakers, and it should concern everyone," ACLU spokeswoman Alessandra Soler Meetze said. "It's an extremely frightening prospect when the governor negates a court decision . . . simply because he disagrees with the outcome."
The ACLJ joined the legal battle this week; Chief Counsel Jay Sekulow will argue that there is ample precedent for the governor's involvement.
"The Legislature has a role to play here," he explained. "The courts are not the sole and only arbiter of life-and-death decisions. What's interesting here is that the governor of each of the 50 states -- including the governor of Florida -- has the authority to issue a stay when it comes to someone on death row."
This case could have a significant impact on the right-to-life debate in Florida -- and beyond.
"The scope of this case is well beyond Terri Schindler-Schiavo's life, although that is obviously very significant," Sekulow explained. "It involves the whole role of what the legislative process is concerning life-and-death matters."
The trial should begin by the middle of November.

It's a dangerous abuse of power alright, but it isn't the lawmakers and the governor who are abusing it.
And shortly before that, Jerger took over a company run by Steve Beaty...how could we find out if there was insider trading on that?
Or are those types of takeovers done in a way that there would have been no insider trading?
I'm not saying that anyone we've mentioned here on FR was involved in "insider trading" (whatever that is), I'm just asking a general question about persons unknown.

Beaty, 41, started as an industry outsider with his own company, Micro Business Systems, providing software to independent agents. For Pinellas Park-based The Jerger Co., he developed a pioneering program that allowed it to quickly identify mobile homes by ZIP code and park. Thus, it could grow into the largest independent mobile home insurer in the Southeast, even as it spread its risk so that a single tornado didn't mean catastrophe for Jerger. In 1986, he sold Micro to Jerger and became its chief information officer. When Jerger was sold this year, Beaty jumped to Bankers.The Jerger Insurance subsidiaries gained Philadelphia Consolidated's A+ rating in after they were bought in 1999.

The Schindlers hold a press conference showing a videotape of Terri interacting and being responsive. Pops Schindler was worried that he would be held in Contempt of Court for making the videotape public. Much to everyone's surprise, Michael Schiavo briefly took away the Schindler's visitation privileges instead.

Mr. Jerger subsequently resigned his position with the Company effective November 22, 1999 and the Company entered into a severance agreement with Mr. Jerger agreeing to pay Mr. Jerger the Base Salary through the original employment period of five years. 10/31/2003, All Hallows' Eve, Evening Prayer Vigils Resume
As you know, Mr. Schindler profoundly believes that as a result of your prayers, Terri is still with us today. Currently, legal proceedings have begun for Mr. and Mrs. Schindlers' fight for guardianship of Terri. In addition, the Schindlers are fighting Attorney George Felos' attempt to challenge the constitutionality of Terri's Law. The American Center for Law and Justice is joining the Schindler family and their local attorney in this regard and wish to uphold Terri's Law. We are very encouraged by this!
Many calls have been received by the public asking, "What is going on now?" and "What can we do?" Prayer is the most powerful weapon we have in the battle for Terri's life. Please continue to pray, and if you are able, visit the site of the vigil once again. Many of us are peacefully lighting candles at dusk Friday, Saturday, and Sunday evenings each week to pray for both Terri's healing and for her protection. This prayer has given this fight for Terri's life the momentum it gravely needed. We are asking for your perpetual support. Please tell all your friends, church members, prayer groups, sports teams, class mates, and families that we need your help. Terri cannot speak for herself yet and it seems that the siege is just beginning after thirteen long years.

Mr. and Mrs. Schindler will be on Larry King next Thursday. We don't believe the official release has been given on this, but stay tuned for further updates. This is the best information we have at this point.
