Judicial Watch says it now has given Jeb Bush premise to intervene

The Washington, D.C., watchdog group Judicial Watch filed an abuse complaint it says will allow Florida Gov. Jeb Bush to intervene on behalf of Terri Schindler-Schiavo, the brain-disabled woman who is starving under a court order initiated by her husband.

Judicial Watch President Thomas Fitton faxed a "Form to Report Abuse/Abandonment/Neglect/Exploitation" with the Florida Department of Children and Families yesterday then sent a letter to Bush and DCF Secretary Jerry Regier.

The letter said, "Based on our formal complaint via the faxed report referenced above, you have the authority and sufficient cause to immediately order the Florida Department of Children and Family Services to intervene on behalf of Ms. Schiavo; to restore her nutrition; and to initiate a full investigation of the circumstances surrounding Ms. Schiavo’s disability."

Fitton said these actions are in accord with the U.S. Constitution, the Florida Constitution, Article 2, Section 5, and Florida statutes 825.102 and 782.04(2)(i), 77.04.

The abuse report, under "Description of Incident," says:

Thirteen years ago Terri Schiavo suffered brain damage from a sudden collapse. She receives her food and water by means of a feeding tube. Terri's other bodily functions are stable. She responds to voices, and is capable of smiling, laughing and crying. She vocalizes well.

Terri's husband, Michael Schiavo, has denied her any rehabilitation treatment since 1993. On Wednesday, October 1, 2003, Michael Schiavo directed that Terri's feeding tube be disconnected, subjecting her to starvation and dehydration that will result in an anguishing death in approximately 10 to 14 days.

Judicial Watch is known for its many lawsuits against President Clinton's administration. But the group, led by Larry Klayman, also has taken on the current White House, including a lawsuit to force the release of information about Vice President Dick Cheney's energy task force.

Klayman recently declared he will run for a U.S. Senate seat from Florida.

This is no longer only Terris Fight... The fight for Terri has become every parent of a disabled childs platform to protect the future right of life for their children.

Well Said! We have a darling 1 yr. old son who has Spina Bifida, the thought that children like him are being aborted everyday by parents who can't imagine life with such a child breaks my heart. He is in every way a normal child with the exception of his mobility issues. God willing he will get around the best he can and develop the fortitude to persevere in spite of challenges in his life.

Mr. and Mrs. Finn wanted to stand by Hugh, but the wife had the guardianship, and she got the feeding tube pulled. How much did she collect then? I understand the parents were treated as badly as the Schindlers have been.

I'm not sure why I'm answering yet another question of yours, but I'll take a chance. I resent it strongly when somee know-nothing loser --it's not you I'm speaking of-- comes along and calls me a "shill" for the cult of death. I'm not a shill. I've dealt with the deaths of 2 very beloved people,
My mother had successful hip-replacement surgery in February. For some reason, after the surgery, she was unable to eat. Food-- liquid or solid-- nauseated her. (We brought her her favorite foods.) Her survival came to depend on her having a permanent feeding tube, which was contrary to the conditions of her living will. In addition, it was explained to her that she would never have the strength to walk. (Therapists tried to teach her how to walk on the new hip, but her memory wasn't working, and she couldn't learn. She was also very weak.) We would have to have her placed in a nursing home for 24-hour care. Mother, sound of mind, though not of body, verbally stated that she did not want "to linger" under those conditions. Having made her choice, we took her home-- her greatest wish-- and arranged for nurses under the guidance of hospice to make her comfortable until she passed.

No, she couldn't. She'd have been saddled with huge legal bills from a GAL in divorce court, and would have had a lifetime of maintenance and care bills, not dischargeable in bankruptcy. As a bonus, she wouldn't have even had the right to select the level or type of care, and the parents and siblings would have ruined her by choosing "the best" - and it would have all been enforceable through contempt power, which includes jail time, even if she didn't have the resources to pay.

Great deal for the kids, eh?

What "taking" occurred that was outside of normal natural order? She simply allowed nature to prevail, and that isn't a "taking", regardless of what some theologians dream up in a sterile environment outside real life.

Guardian Ad Litem - a court appointed lawyer, designated to look out for the interests of the mentally disabled person in this instance. They get paid by the opposing litigant, who has no control over how much gets run up.

Did Mrs. Finn allow Hugh to be fed by mouth? Schiavo won't allow feeding by mouth. Terri might be able to eat some soft foods. This is murder.

I believe the morphine was halted if it ever began in the first place.
Why would she be required to go through this without morphine of some sort? It's not an expensive drug, and she's in a hospice facility, correct? Why do you believe this to be the case?

I'm glad that Judicial Watch stepped up, and I hope that JW is there to step up for us, when Hillary and her cronies
try to win the Presidency in an upcoming election.

We don't want her to win, but we all know that the Clintons are dirty and love dirty tricks.

You know why the media doesn't dig up dirt on the ongoing Clinton misdeeds? They are afraid of being sued for libel!

But, Judicial Watch can dig up dirt via the courts without that fear! What they uncover can then be reported by the Media Press and TV as fact.

Lawyers getting Lawyers.

It doesn't get any better than that!

I've noticed that JW is making progess in the Peter Paul situation and am guardedly optimistic about this (less optimistic now that Klayman is gone and running for the Senate), but frankly that 's another thread for another time.
