It’s academic at this point or soon will be. There has never been an openly foreign born POTUS and that’s not going to change in this election.
Trump will have the delegates. Cruz almost certainly won’t. There is no chance that Donald Trump will quit, not when he’s the clear front runner. There is no chance. The longer the Cruzers drag this out, the more damage they do to the inevitable nominee and, as such, it will not be Donald Trump’s fault when Hillary is elected POTUS.
If I keep fighting? I can’t wait to vote for Cruz tomorrow.

The case was tossed on a technicality not merits, just like the last one. Cruz is simply not a NBC and should not be running.
No surprise at all to me. But I hope the ruling is appealed up, up, and up and we can establish once and for all that the children of U.S. service personnel serving overseas are full citizens.
Chris, it appears we partly agree. Rubio is a citizen only under a misinterpretation of the 14thA (he was born here but not to citizen parents) and he is certainly not an NBC.
With regard to Cruz, well, what do you think about the question in my tag line?
As you think about it, let me remind you the Constitution describes the quals for reps and senators as being citizens for only the past 7 and 9 years. That means they could have been born anywhere to anyone 60 years ago and only recently have gone to the trouble of becoming a citizen.
OTOH, isn't it likely the qualification for the single highest office in the land requires a higher form of citizenship? If not, the founders could have used the same language it used for reps and senators. But no, they specified NBC.
Even further, the USSC in Minor held there was no doubt NBC included born within to two parents, but that there was doubt as to other configurations. What can we point to that supports a conclusion that when the founders specified NBC for the highest office they meant it to be in its doubtful form?

This is my nightmare scenario if Cruz makes it that far. The electoral college will be tweaked and manipulated and they will "decide" that he is not natural born. There is no remedy after that. What they decide goes.

So every random person who passes on misinformation to another random person is now some kind of authority on a subject? There was no need to pass on this silly, irrelevant story.
As far as Cruz goes, it’s just the way I look at it. I think that his being born out of country but to an American parent qualifies him as NBC. I know that there are people who disagree with me on that.
As far as the question in your tag goes, it appears to me after watching this NBC situation since it started with Obama that the reality of it is no authority is going to tell anyone that they cannot run for president.
It appears to me that anyone who can claim even the weakest link to American citizenship can run, and it’s up to the American people to accept or reject that person.
I’m pretty sure that a person born in Germany to two German parents who never set foot in America would not be able to run, but you know that’s just a guess on my part.
At this point, I am sure someone will test that and have a chance at getting away with it.
It doesn’t seem to me that any authority is going to tell anyone that they can’t run for president based on where or how they were born.
Dismissed on technicalities alone.
No ruling on the merits.
But, one of the states will soon deny Cruz access to their ballot through normal, legal state process.
And that's when we'll get a decision on the merits in a federal court.
How soon? Which state? Will there be unicorns on the courthouse steps?

I think this is why Lawrence Tribe called Cruz a hypocrite...because he abandoned his “originalist” principles when it came to furthering his own ambition. And we’ve seen him go on to do similar things in his campaign.
There, Cruz says that to be a Natural Born Citizen, two parents have to be born on the soil and then says that Obama is ineligible to be POTUS.
I wonder why Cruz considers himself "eligible" since one of his parents was not born on the same soil as the other and neither was he.
It is called ‘entitlement’... Obama got away with it and so now Cruz intends to pull the same scam.

It sounds like the courts are saying, if the person didn’t go through the naturalization process, the court is going to assume that it isn’t a matter for the courts.
I don’t like it, but in a sick twisted way it makes sense.
If someone was naturalized through the naturalization process, then obviously they aren’t a natural born citizen. That is legally and objectively documented.
