CHARITON, Iowa — They usually mean no offense, but every now and then, supporters of Ted Cruz bring up The Question.

“I’m sure you’re aware that the Constitution requires the president to be a natural-born citizen,” David Bishop, a teacher, told Cruz during a stop Saturday night in this small southern Iowa city. “Don’t get this wrong: I’m supporting your candidacy, but I hope this doesn’t become an issue for you.”(continued)

The Naturalization Act of 1790 was repealed by the Naturalization Act of 1795 The Naturalization Act of 1790 stated that "the children of citizens of the United States, that may be born beyond sea, or out of the limits of the United States, shall be considered as natural born citizens: Provided, That the right of citizenship shall not descend to persons whose fathers have never been resident in the United States."[22] This act was repealed by the Naturalization Act of 1795, which removed the characterization of such children as "natural born," stating that "the children of citizens of the United States, born out of the limits and jurisdiction of the United States, shall be considered as citizens of the United States" while retaining the same residency restrictions as the 1790 act.[22]

Cruz’ father did not become an American citizen until 2005.

Cruz has the same pedigree as Obama..one US citizen is a parent. Location of the birth is not important unless the US citizen is a minor.
Congress should pass a law that all candidates for President must agree to having their passport file made public..along with other Federal records.

Ted Cruz wouldn’t have had a passport file for Canada. Right off the top he was born with dual citizenship and we didn’t need a passport until very recently.

This question was fought out eight years ago and our side lost. I can’t see the upside of renewing the fight now.

Still name calling, relax, take deep breaths, and try to remove your head from your a$$.

I'm not sure you have the mental capacity to comprehend any responses I may have to your questions, so let's just ignore each other.

...and this is happening when we have a SITTING “president” that refuses to prove his citizenship? If Obama give us the original birth certificate and college records, then they might have a point of discussion...but as long as the Obama presidency is “real” any question on Cruz or anybidy else is mute. It obviously no longer matters.

“stating that “the children of citizens of the United States, born out of the limits and jurisdiction of the United States, shall be considered as citizens of the United States” while retaining the same residency restrictions as the 1790 act.[22]

True, but a Naturalization Act cannot amend the Constitutional requirements to be president.

“considered as citizens”, but it does not specify “natural born”, used in the Constitution along with other exclusionary criteria (age, residence), which means, of course, that merely being a citizen is not necessarily “natural born”.

When McCain was running, Congress felt it necessary to publish something that declared McCain was eligible to run. No one questioned that he was a citizen at the time.

If Congress passed a law stating that “infringed” no longer means what it has always meant, that still would not change its Constitutional meaning.

If States are willing to place him on their ballots, then it won’t matter.

It is in the Constitution - it just requires a little reading comprehension. They clearly made a difference between a Representative, a Senator and a President.

To become a Representative -
No Person shall be a Representative who shall not have attained to the Age of twenty five Years, and been seven Years a Citizen of the United States, and who shall not, when elected, be an Inhabitant of that State in which he shall be chosen.

To become a Senator -
No person shall be a Senator who shall not have attained to the Age of thirty Years, and been nine Years a Citizen of the United States, and who shall not, when elected, be an
Inhabitant of that State for which he shall be chosen.

No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.

McCain was not born on a military base. He was born in a civilian hospital outside of the Canal Zone. My sister was born in the same hospital. When she went to register to vote she found out that she was an illegal alien and was supposed to have been reporting to the post office each year. Dad got it fixed for her, but it was a mess.

Cruz has suggested that the issue was put to bed once and for all by a Harvard Law Review article published 12 days before he launched his campaign. In the article, two former top Justice Department lawyers, Paul Clement and Neal Katyal, wrote “there is no question that Senator Cruz has been a citizen from birth and is thus a ‘natural born Citizen’ within the meaning of the Constitution.”

Of course he did. It’s in his best interest to ignore the law and the meaning of natural born citizen.

And anyone who says that a citizen from birth and a natural born citizen are the same thing really shouldn’t be running on being a constitutional scholar. More likely, a lawyer looking for loopholes.

Please check your facts.

Congress didn’t approve McCain’s eligibility. They passed a non-binding resolution stating they believed he was eligible. (Likely a signal to the courts where they stood on the issue.)

McCain was not born on a military base. He was born in a hospital in the Canal Zone. Regardless, military bases are not considered U.S. soil where citizenship is concerned.

I did not post the article.

??? I never said you did, and so what?

Here's what you said that I was replying to: "Ted is no more a Natural Born Citizen than Obama. Both parents must be citizens."

To which i replied: "This question was fought out eight years ago and our side lost. I can't see the upside of renewing the fight now."

I agree. They specifically removed the “natural born” part, five years later.

If Obama gets to be President with an American mother, African father and mostly foreign upbringing, Cruz gets to be President with an American mother, loyal immigrant father and American upbringing.
