Democrats’ midterm gains have opened a path to fundamentally changing how America elects its president, potentially locking in the national popular vote winner through an interstate agreement.Check Voting Info
The National Popular Vote Interstate Compact would leave the Electoral College formally intact while changing how participating states award their votes. A member state could back one candidate at the ballot box and still hand every electoral vote to that candidate’s opponent.
That is because the agreement commits participating states to awarding their electoral votes to whoever wins the most votes nationwide, regardless of the outcome within their borders.
The compact activates only when its members collectively control at least 270 electoral votes, the majority needed to win the presidency.
Eighteen states and Washington, D.C., have enacted it, accounting for 222 electoral votes. Supporters need another 48.
Tuesday’s elections put that threshold within reach.
Democrats won unified control of state government in Michigan, Nevada, Pennsylvania and Wisconsin. Those states hold a combined 50 electoral votes, enough to bring the compact to 272 if all four join.
Arizona holds another 11 electoral votes. Democrats were also projected to gain unified control there, although some legislative races remained uncalled Thursday evening. Adding all five states would push the compact to 283.Check Voting Info
But new Democratic majorities do not guarantee passage, and the party has previously failed to enact the agreement even when it controlled state government.
Michigan Democrats did not join during their 2023-24 trifecta, when they held the governorship and both legislative chambers.
Nevada’s then-Gov. Steve Sisolak, a Democrat, vetoed the proposal in 2019, citing concerns about the state’s influence in presidential elections.
Even if enough states sign on, a constitutional showdown could follow.
Article II, Section 1, Clause 2 allows states to appoint presidential electors “in such Manner as the Legislature thereof may direct.”
Supporters argue that provision gives states the authority to allocate their electoral votes based on the national count.
Opponents point to the Constitution’s Compact Clause, which restricts interstate agreements without congressional consent. Whether this compact requires that approval remains disputed.
Democratic control of Congress would not automatically resolve those questions or sideline President Donald Trump.Check Voting Info
The Congressional Research Service has explained that congressional consent to interstate compacts generally requires approval by both chambers and presentation to the president. If that process were required, Trump could veto the legislation. Overriding him would require two-thirds support in each chamber.
Senate Democrats could also face a Republican filibuster under current rules.
The political stakes are clear. George W. Bush won the presidency in 2000 while losing the national popular vote, and Trump did the same in 2016.
If implemented and upheld, the compact would commit a decisive Electoral College majority to the national popular vote winner, changing the presidential contest even in states that never joined.

No reason to vote if CA and NY chose the winner. America is so screwed.
Ain’t communism wonderful. We will be Venezuela in 5 years.
Speaking of, bet you a dollar Maduro will eventually be back in power in Venezuela.
They need to get the drug and child sex cartels moving again to fund their elections.
Nothing says “screw you” to a state’s voters than giving its electoral votes to the LOSING candidate in that state.
The level of bullshit and pearl clutching in these repeated threads on this subject are ridiculous. The electoral college is going nowhere regardless of the fear porn seminar posters. Post another 500 times about it. The answer won’t change.

“Potentially”. Such a compact would only mean something were it to compel a state to cast its electoral votes contrary to the majority vote of that state. Not only would that be politically unpopular in such a state but it would face obvious, substantial legal challenges under state constitutions. So there are legal experts saying this would be valid under the federal constitution. But even if true, and that is not certain, there would be plenty of state level challenges.
But if the Dems keep Congress and elect a Dem president in 2028, they could simply pass a law, no super majority required, to admit Puerto Rico as a state. For that matter, they could admit Ukraine or Mexico or anywhere else. There’s no limit to this power. It’s a time bomb built into the Constitution.
Had the "compact" been in effect in 2024, do you seriously believe California would have given 54 EV to Trump/Vance?
Like a lot of Leftist things, if this ever happens, it will only work in one direction.
Oh, I know! They would call an emergency legislative session to reverse their "compact" legislation before certification, pass it before lunch, and vote on it before 4:00. And the governor would stay over that evening to sign it.
Well, if this stolen election is allowed to stand we pretty much already are Venezuela or Brazil.
Agree 100%. EC is not going anywhere. Takes majority of Congress and majority of States to pass.
People need to calm down and focus.
Presumably they would attempt this by passing a law the president could veto. If the veto were over-ridden that law would be subject to SCOTUS review.
It appears to me that 2028 may be the last free election in USA. We won't bother to show up to vote after that.
For now, correct.
There are no guarantees after 2028.
Now you know why Biden’s handlers opened the border and brough in 30+ million illegal aliens.
And why Democrats were freaking out about deportations.
19 million additional Democrats voters from 2022 to 2026.
Republicans got complacent after the 2024 election.
Trump, Noem and Mullin failed to deport everyone.
They failed to debank illegal aliens.
Thune failed to secure our elections.
There is no coming back from this.
I wonder how many states would secede if they try.
All we had to do was to hold on and win the White House in 2028.
Now it's much harder for a Republican to win.
It's likely that AOC/El-Sayed will be the ticket.
