family’s beloved pet donkey was shot and killed by Georgia cops after the tiny ass allegedly confronted them when they ran through his pasture.
Hannah Israel, 30, said officers entered the family’s property in Cedartown — near the Alabama border — without notice at about 12:45 a.m. while chasing a suspect when they came across HeeHaw.
“They claimed he ran up to them braying and they thought they were in danger and shot and killed him after trying to Taze him,” Israel wrote on Facebook
"HeeHaw was raised in the house and did petting zoos he never knew a stranger,” Israel added. “And was shot and killed in his OWN pasture for doing what donkeys do. Alerting to a stranger.”
A haunting photo taken during the aftermath of the shooting showed Israel crying over the dead donkey, whose eyes remained wide open as it laid on the ground.

There is something profoundly broken in some people. “It was a potential threat”; means you need to find another line of work. Split second decisions are not part of your skill set. The excuse proffered actually proves it.
Why did they shoot the donkey? Because a dog wasn’t available.
The donkey was no threat, if it was behind a fence.
I am aware of donkey aggressiveness when it comes to canines.
The donkey was probably charging them with a knife. Clear cut self defense.

Your definition of “malice” doesn’t apply. From the same statute:
(2) “Malice” means:
(A) An actual intent, which may be shown by the circumstances connected to the act, to cause the particular harm produced without justification or excuse; or
(B) The wanton and willful doing of an act with an awareness of a plain and strong likelihood that a particular harm may result.

I don’t recall defining ‘malice’. But the word was in the law you quoted, and doesn’t apply. The officer is not going to be charged with ‘animal cruelty’.
You made the assertion. I think it’s reasonable to expect that you back up what you claim as fact, so post your proof of ‘widespread’ use by cops.

If the donkey was braying and challenging the cops, I would think the donkey would bray and challenge the suspect they were looking for, right ?
In other words, the guy isn’t hiding out in the donkey corral or field.
They should have kept on moving and left the donkey alone.
They were not looking for a suspect. They were looking for a missing child.
STUPIDITY CERTAINLY WAS
I have no problem with designating this as a case of ‘stupidity’.
But the idea that this was the result of malicious and aggravated cruelty doesn’t fit. According to the article, they tried to tase the animal first; that doesn’t indicate a desire to kill it.
This one was a mini. I have a regulation-sized, intact donkey across the road from me and his job is to protect the goats and sheep from a few bad neighborhood dogs. We also have Anatolian shepherds and Kangals guarding herds. Those cops need more extensive training if they’re going to function around livestock.
I guess widespread needs to be defined but it has become a concern.
