(LEX NEWS) — Former Rowan County Clerk Kim Davis is facing new allegations in federal court that she provided false sworn answers while creditors attempted to collect on a judgment exceeding $565,000 stemming from the high-profile same-sex marriage case that drew national attention nearly a decade ago.
In a motion filed July 28, attorneys for plaintiffs David Ermold and David Moore allege Davis falsely stated under oath that she owned no property and had not made significant transfers of personal assets.
The filing contends public records show Davis inherited interests in multiple parcels of real estate and later transferred those assets to relatives and a family trust without receiving monetary compensation.
According to the motion, the properties were transferred to family members, including Davis' husband, son and brother, as well as a trust established for family beneficiaries.
The filing alleges the transfers occurred after appellate courts upheld the judgment against Davis and while collection efforts were ongoing.

Could possibly have been done legally with a disclaimer of inheritance. I’ve used these in estate planning to transfer life insurance from the spouse to the secondary beneficiary, back when the federal estate taxable estate started at $600K.
It stops the heaping of assets in the surviving spouses estate. Can also be used to avoid money going to Medicaid recapture rules where medical bills, including nursing homes, would take the money.
The qualified disclaimer must be executed within nine months of the original owner’s death, ensuring you never accept the asset or choose who receives it.
Key Rules for a Qualified Disclaimer
Written and Signed: Must be a clear, permanent, and unconditional refusal in writing.
Time Limit: Must be delivered to the estate representative or financial institution within 9 months.
No Control: You cannot pick who gets the property next; it must pass naturally according to the original will, trust, or state law (treating you as if you died before the owner).
Zero Benefit: You cannot accept any income, gifts, or use of the property before disclaiming it
You also cannot be insolvent when you execute the document, and states vary on how far back they look for insolvency prior to the disclaimer.

I don't understand it at all - as it seems the only damages they could have incurred was delaying them having to spend money on gas and losing around a half hour tops to get to the next clerk's office. That is all they should have been awarded - a tank of gas and maybe the cost of a nice steak dinner for the loss of time. Did her attorneys not make that case in the trial?

You can be insolvent, as long as you have not filed bankruptcy as the bankruptcy trustee is the person to make or reject the disclaimer.
You could also disclaim any possible inheritance before the person dies. Once he dies, you can’t retroactively change the will or disclaim the inheritance.
