An immigrant-led business group is gearing up to sue New York City over Mayor Zohran Mamdani’s controversial plan to open five taxpayer-funded supermarkets — claiming the $70 million project will create unfair competition for nearby stores, The Post has learned.
As the far-left mayor announced new details of his plan this week — including a 30% discount on basic items like produce, meat, milk, cheese and bread – the Multicultural Business Coalition’s board voted to file a lawsuit in the coming weeks to block the pricey initiative, the group’s chairman Frank Garcia told The Post.
“The mayor doesn’t seem to want to sit down with us,” Garcia said, adding that Mamdani “won’t be able to bully these lawyers we are going to bring in.”
The mayor’s office did not immediately respond to a request for comment.
MBC - formed earlier this year to create a unified front against Mamdani’s grocery policy - includes 50 chambers of commerce representing Asian, African, Caribbean, Hispanic, Middle Eastern and Jewish-owned businesses in New York.
The nonprofit MBC plans to raise $1 million to fight some of the mayor’s initiatives, Garcia said, adding that the suit “should be a non-partisan initiative.” The group plans to send a letter in the coming days notifying Mamdani’s office of its plans to take legal action.
The funds will go toward the lawsuit and efforts to raise awareness about the plight of its mom-and-pop shop members, many of whom struggle to secure capital, fend off shoplifters and keep up with rising costs including rent and taxes.
Garcia declined to go into detail about the specific allegations in the forthcoming suit.

These stores make absolutely no sense since 20% of NYC residents receive SNAP. And if you’re not eligible for SNAP, you have enough to buy groceries at a regular store...just like you and me.
They will be like Soviet grocery stores only with more ethnic diversity. Who wouldn’t love to shop in such an environment?

Great idea. Sounds right to me. It’s not the function of the government. The US Constitution is 180 degrees opposite of socialism.
The money has already been spread around. Actually opening the municipal grocery stores is not absolutely necessary to the graft project.
I love this story. Mayor Zero, trying to go far-left with city owned grocery stores, has run afoul of “the Multicultural Business Coalition.” You just can’t please every socialist all at the same time, Zero.
The lower 10% of New York work for the current grocery stores.
I like his plan of selling, weekly rotating, staples at 30% off market price.
The small grocery owners should get there early and buy it all to sell at market price in their stores.
Is Madmani going to run food wholesalers? I doubt C&S will give him a discount...

Ok, how much is Mamdani going to pay those who work in and manage his stores? How do they decide who works there and how much they get paid? What about local and state property tax? Or state & local sales tax. If they don’t pay, it’s unfair competition, right…..violates equal protection.
And federal payroll taxes rise with the generous payroll.
But what is the federal income tax status of a Mamdani store? Is it a “ non profit”, despite being so overtly political?
And here’s the kicker:
Since the Supreme Court decided the corporate income tax is an “ excise tax”, ie a tax on goods and services, ie a consumption tax….how can Mamdani stores dodge an excise tax like that?
If I were Trump and GOP, I would use these stores as proof the corporate income tax is not really an excise tax, the decision was fudged all those years ago, and the corporate income tax was unconstitutional and should be ended. It was created to tax rich owners of corporations before the individual income tax was passed by lies leading to a constitutional amendment…..but now, the corporate income is not fairly administered and is a tax dodge for billionaires…21% rate, lots of deductions individuals don’t get, and a 15% tax on dividends. …..but how can New York City run a business and not pay federal excise tax other businesses pay? Who buys the goods? Who decides inventory? Do they get preferential prices from suppliers. Walmart has its own warehouses as do other supermarket chains, and vendors pay them to carry and place their products. ..set up displays..etc
Right. If there was a VAT to replace the corporate income tax and/ or tax on business payrolls…., Mamdani would have to pay a federal VAT when he buys inventories.
