A U.S. Immigration and Customs Enforcement (ICE) agent is facing felony charges in Minnesota after prosecutors said he pointed a gun at two people during a highway confrontation.
This comes as no charges have been filed in the separate attack on Turning Point USA reporter Savanah Hernandez.
Hennepin County Attorney Mary Moriarty announced charges Thursday against ICE agent Gregory Donnell Morgan Jr. tied to a Feb. 5 incident on Highway 62 in Minneapolis as part of the broader "Operation Metro Surge" federal immigration crackdown that drew protests and scrutiny in the Twin Cities.
Morgan "sped up, pulled alongside the vehicle, matched its speed, opened his window and pointed his duty weapon directly at both victims," Moriarty said during a press conference.
According to a criminal complaint, the incident unfolded around 4:20 p.m. near the Interstate 35W interchange as traffic slowed to a single lane. Prosecutors said Morgan drove on the shoulder to bypass congestion before pulling alongside the victims and pointing a handgun at their heads.
Investigators said Morgan was driving a rented SUV with no markings identifying it as a federal vehicle. Both victims said they felt threatened by his actions, according to the complaint.
Investigators said Morgan was not responding to an emergency at the time and told authorities he was heading back to the Whipple Federal Building to end his shift and get gas.
Morgan told investigators he feared for his safety, yelled "Police! Stop," and believed the individuals were "agitators" who cut him off because he was a federal agent, according to the complaint.
Authorities have issued a nationwide warrant for Morgan’s arrest. He faces two counts of second-degree assault, each punishable by up to seven years in prison. Bail was set at $100,000, with conditions including no possession of weapons and compliance with all court...

“ Authorities have issued a nationwide warrant for Morgan’s arrest.”
Grandstanding much? States issue arrest warrants with the agreement to extradite. Officers, when faced with a foreign jurisdiction warrant will not arrest unless they can confirm the jurisdiction will extradite. And it isn’t like other states will be going to look for him. If they encounter him, and the above issues are met, they will take action.
When the FBI was American, Moriarty would have already been arrested.
I thought I read the Feds were getting involved in the assault on this woman? Violation of her civil rights or something along that line.
If the agent did as accused, and the prosecutor says they have video of the vehicle on the shoulder (not the pointing of the gun) and an admission of the pointing of the gun, the agent should be charged.
The agents were at the end of the shift. They were in a rented vehicle. They were not using lights and siren.
We would be arrested and charged if we did what they are said to have done.

No sane state is going to order their armed officers to take action on an armed federal agent to prosecute an extradite process in this questionable case.
I can see a potential problem if local police officers, with pointing guns surprise armed federal officers. Lots of shooting may take place with a lot of dead people.
This case is weak as while federal agents do not have absolutely immune from state laws while carrying out their duties but they have a strong form of protection under the U.S. Constitution’s Supremacy Clause in many situations.
For example a similar issue was brought forth in the Ruby Ridge case, Idaho v. Horiuchi, 215 F.3d 986 (9th Cir. 2000).
Horiuchi was an FBI officer who fatally shot an unarmed woman during an FBI raid on a ranch in Idaho. He had intended to shoot the armed man near to her.
The state of Idaho subsequently brought criminal charges against the federal officer for involuntary manslaughter of the woman.
The court dismissed the charges. The officer was immune from the state charges through the Supremacy Clause because they found that Horiuchi was acting within the scope of his duties at the time, and he “reasonably thought” his actions were necessary and proper.

Do they have a video of the car cutting off the ICE agent?
RE: Authorities have issued a nationwide warrant for Morgan’s arrest...
Even on the Mayberry police radio.
Do they have a video of the car cutting off the ICE agent?
It was not an emergency. They were ending their shift.
Just because a person has a badge and a gun does not mean they can do anything they want without consequences.
There is supposed to be traffic video of the incident, then some phone video of the incident after the alleged pointing of the gun.
It is alleged the ICE agent admitted pointing the gun.
If this were ATF agents doing this, many would be cheering the Minnesota prosecutor.
