Chicago Area Judge Rules ICE Agents Can Be Arrested
Independent Journal Review ^

Posted on 10/22/2025 5:59:55 AM PDT by Tench_Coxe

A federal judge in Chicago just made a decision that’s raising eyebrows — and not just among immigration officers.

In a move that’s already stirring debate nationwide, U.S. District Judge Jeffrey Cummings ruled that ICE agents — yes, federal officers — can be arrested if they take migrants into custody at Cook County courthouses without a proper warrant. Let that sink in for a second.

(snip)

So, who’s actually in charge here — federal law enforcement… or local judges?

And if ICE agents can be arrested for doing their jobs, what kind of message does that send to those who aren’t even supposed to be here in the first place?

Good point....but I doubt if the Feds will capitulate even if there was a warrant. The judge will have to get federal officers to arrest. ...judge is physically incapable of doing himself. Boils down to that.
Judge is trying to get martial law imposed and give reason for armed rebellion.

Not so very long ago, we were talking about “Second Amendment Sanctuary” cities/counties/states ... and the possibility of local law enforcement arresting federal agents who attempt to enforce federal gun confiscation laws that democRATs want to enact.

The search function on FR works.

If the warrant is not proper, the cop gets arrested. Do we really want to go there?

YES! "Law enforcement" officers/agents need to obey the law.

What CRIME would these federal agents be charged with?

This all further propagation of the false “due process” arguments of the left. If there is a deportation order from an immigration court, illegals can be detained and deported. The statutory Due Process would only be violated if there were deportations without an immigration court order. Congress has codified the due process for illegal aliens. No warrants needed, just an immigration court order. Period.

collateral arrests . . . ICE officers . . . stumble across another individual who’s also in the U.S. illegally

The more the merrier!

“While you might disagree with the enforcement of our federal immigration laws, there is simply no legal basis for you to hold federal officers in criminal contempt for carrying out their sworn duties,” [US Attorney] Foley wrote to the municipal judge on April 2. “Any attempt or threat to interfere with the lawful functions of federal government agents will not be tolerated.”

It’s the Second Amendment. It’s in the Constitution. It is a Right of the People.

Illegal immigration is not. It is illegal and under the purview of the Executive by an act of Congress.

The two are not the same in any way.

Interfering with the legal enforcement of Federal law is nullification if not insurrection. If a ‘Rat Congress or President illegally suspends the Second Amendment over the the objection of the States and the People then civil war is justified. QED.

“Lets see what happens if/when the first arrest is made.”

Let the Democrats games begin, just like they did in 1866 and all the way to Civil Rights. They challenged federal government, and every time they got destroyed. Time for another reminder it seems.

Since ICE agents haven’t been arrested when collecting illegals at other courthouses in the country, it would seem that precedent is already established, and this Judge is overreaching his authority.
