US Senators have asked India's largest IT firm TCS to furnish details about its hiring practices in the US, whether the company has displaced any Americans with H-1B workers, as well as wage parity between H-1B hires and its local US staff.
In a recent letter to Tata Consultancy Services (TCS) CEO K Krithivasan, Senate Judiciary Committee Chairman Charles Grassley and ranking member Richard Durbin noted that the company has announced plans to layoff over 12,000 employees worldwide, including American staff.
TCS laid off nearly five dozen employees in its Jacksonville office alone, according to the letter.
"At the same time you have been laying off American employees, you have been filing H-1B visa petitions for thousands of foreign workers," it said.
The letter cited data from fiscal year 2025, when TCS received approval to hire 5,505 H-1B employees, noting this made the company the second-largest employer of newly-approved H-1B beneficiaries in the US.
"With all of the homegrown American talent relegated to the sidelines, we find it hard to believe that TCS cannot find qualified American tech workers to fill these positions," Senators Grassley and Durbin said the letter dated September 24, 2025.
Emphasising that TCS was already under investigation by the Equal Employment Opportunity Commission for allegedly firing older American workers in favour of newly hired South-Asian H-1B employees, the letter went on to say that the company "is doing itself no favours by replacing Americans with H-1Bs while this investigation is ongoing".

Like we need a couple of dinosaurs in congress to tell us what’s going on. This has been happening for decades and they all knew. Now it’s CYA time as usual.
It’s a shell game..
It’s not just about the take home pay of the worker.
That US worker employed by a co. might “make” $10/hr..
While the H1b gets paid $10/hr or $9..
But, does the co have to pay the visa holder’s unemployment? Sick, vacation? medical, etc? SSA, Medicare withholdings..
That $10 for a US worker, after benefits, likely costs that co $20/hr.
Sadly, it would not be hiring them if it didn't feel they were better trained for the job at a given price. If they are equally trained, but the H-1B will work for less, then the American worker needs to lower their wage expectations. You can't blame TCS for hiring the best workers at the best price in a free market. With the $100K penalty that's proposed, someone is going to end up paying the increased cost and that usually is the end customer...us.
Look around in any midsized community and observe who are driving the hot cars and those who are driving used vehicles.
That should tell you who is employed in middle-top management. Most aren’t Americans.

Looking for the solution to the problem is easy enough. Just look at the American education system. The teachers are mostly commies or just disinterested fools, and they teach to the de minimis. No one is allowed to be any smarter than dumbest one in the class....and that’s often the teachers themselves.

This makes no sense, there is an endless supply of cheaper foreign labor that are willing to work for less than American workers. There are 1.5 BILLION people in Indi alone, so they have enough to displace all Americans many times over. The question is what kind of country do we want to live in, not subsidizing tech billionaires in Silicon Valley to buy bigger yachts.
Not what the law states. Law requires no H1-B is allowed if an american can do the job...independent of cost
