Florida AG refuses to back down after contempt ruling in state immigration law battle

Florida officials are pushing back after a federal judge temporarily blocked the enforcement of a new state law targeting undocumented immigrants.

State Attorney General James Uthmeier was held in civil contempt earlier this year after sending a memo arguing that the judge’s order was legally flawed and did not prevent law enforcement from upholding the law, which was signed by Governor Ron DeSantis.

"She wanted me to direct all of our state law enforcement to stand down on enforcing Florida's new state immigration law, and I was not [going to] do that," Uthmeier said Thursday during an appearance on "America Reports."

Uthmeier claims the judge has "overstepped her bounds," and he has not walked back his actions.

"If being held in contempt is the price to pay for standing on principle and standing on the law, then so be it," he said.

Those judges should be removed from the bench. Separation of powers. Judges are not of the executive, or legislative.

I was checking that pesky constitution thingie and there it was!!!!
The power to regulate immigration was specifically granted to the fed.
This means that a state or local government cannot pass any laws pertaining to immigration.
IT IS UNCONSTITUTIONAL.
While this judge is a looney tune leftist, even a broken clock is right twice a day.
Correct ruling.

Migrating, Trespassing, Invading ... it’s a slippery slope.

I grew up near the Mexican border we always called the Illegal Aliens.

Migrants were those that came over to do seasonal farm work.

The word “Invasion” is also in the Constitution. Do states have the right to defend themselves from invasion? I would argue yes, but I’m not a Constitutional expert.

I would argue that if you enter legally following federal law then you are an immigrant. Otherwise you are an Invader.

Boy am I glad I didn't take the Con Law class you were teaching.

No one in Florida is making immigration law. The governor's law grants Florida law enforcement the right to assist the federal government in its enforcement in Florida of federal law already on the books.

These politicized judges are the ones violating the law. By assuming for themselves the right to veto the actions of state governors and legislators, whenever decisions by those bodies (which represent the people of the state) don't align with the judges' disdain for the actual rule of law.

Bottom line, this judge wishes to perpetuate Florida as a sanctuary state, safe for all illegal aliens to reside in.

"(Judge Williams) has ordered Uthmeier to submit bi-weekly reports detailing any arrests, detentions, or other law enforcement actions taken under the contested law. He must also immediately notify the court of any arrests under the law and provide full details."

Demanding that the Florida Attorney General and his staff devote chunks of their valuable time to provide her with "progress reports" is proof this Obama appointee is grinding a pro-illegal-immigration agenda intended to disrupt rightful deportations.

Incorrect. Individuals who are in the country illegally have committed, and are committing, a crime. State law-enforcement doesn’t have to turn a blind eye simply because the feds dictate immigration policy. This is especially the case if the current administration supports the state in enforcing immigration law.

Florida is not making or “regulating” any immigration laws, only enforcing those already in place at the behest of the executive branch.

The Mexican Reconquistas in California have been saying what you said for decades.

When Prop 187 passed, that’s what Mariana Pfaelzer said in her opinion on the law, putting an injunction on parts of it.

So all of those people angrily shouted what you just did - “Only dee federal gobernment can make dee eemeegration law!”

And then when the federal government tried to ENFORCE those laws….they all rebelled and said we are “sanctuary states”.

IOW they want it both ways, and the claim about federal supremacy is a complete fraud.

The states are not making a law concerning naturalization, and even the federal courts have ruled that the states CAN make laws regarding immigration that are consistent with existing federal law.
