Over one year after taking his 15-year-old girlfriend out of Idaho and into Oregon for an illegal abortion, Kaidyn Swainston — 18 at the time of the incident — had his sentence reduced to probation only, after originally being sentenced to five years in prison.
In November of 2023, Swainston and his mother, Rachael, took a 15-year-old girl known as K.B. to Oregon for an abortion. At the time, Swainston was 18, and he was charged with second-degree kidnapping, rape, and three counts of producing child sexually exploitative material. Rachael, meanwhile, was charged with trafficking methamphetamine, two counts of possession of a controlled substance (one for fentanyl and one for psychedelic mushrooms), and one count of harboring a wanted felon. Neither were charged under Idaho’s abortion trafficking law, despite claims from abortion advocates.
K.B.’s mother, Ashley Diamond, contacted police and reported that her daughter had been raped, and taken to Oregon without her permission. After K.B. and the Swainstons were located, K.B. told authorities that she became pregnant after Swainston turned 18, and that she was happy about the baby. Swainston, however, told her she needed to have an abortion or he would leave her, and also refused to pay child support. As K.B. was living with the Swainstons at the time, this insinuated that she could potentially face homelessness if she did not comply with his demands. K.B. wanted to tell her parents, but Rachael said if she did, she would be kicked out of the house.
Rachael scheduled a chemical abortion at a Planned Parenthood facility in Oregon, where she was also treated for several sexually transmitted diseases. Afterwards, K.B. said the relationship went sour, with both Swainstons beginning to “pick at everything she did and make her feel like everything she did was wrong.” They also kicked her out of their home, despite having had the abortion.
Both Swainstons originally faced time in prison, but in October, Sixth District Judge Rick Carroll suspended Swainston’s five year prison term, and gave him just six years of probation instead. The plea deal included dismissing the charges of felony second-degree kidnapping and producing child sexually exploitative material.
Swainston had to plead guilty to rape as part of the deal, though he will not be required to register as a sex offender.

My thought exactly.
Why was this 15yo girl allowed to live with her boyfriend? Why was she afraid to be kicked out? Couldn’t she return to her mother?
It sounds like a bad situation all around. And pressuring this girl to have an abortion was horrible.
But, is it rape? The 18yo was 17 when his 15yo girlfriend moved in. He was facing a life sentence for ‘rape’ because he turned 18.

Why have any laws at ALL? Yeesh! And why wasn’t ‘Grand-Mommy Dearest’ charged with anything?!?!
Luckily this young girl got her STDs taken care of. Hoping she learned a VALUABLE LESSON about lying down with a DOG and his b*tch of a ‘mother.’
