Trump shuts off access to asylum, plans to send 10,000 troops to border

President Donald Trump is preparing to send around 10,000 troops to the southern border, and Border Patrol agents have been directed to deny entry to asylum seekers because they pass through countries where communicable diseases are present, according to a U.S. Customs and Border Protection briefing document obtained by The Washington Post.

The order does not list any specific disease, essentially closing the border to anyone attempting to exercise the right to seek humanitarian refuge under U.S. law.

To start, the Defense Department is expected to order at least 1,000 additional U.S. troops to the southern border in what could be the first of several waves of deployments, according to two U.S. officials familiar with the discussion who spoke on the condition of anonymity because of the sensitivity of the issue.

The CBP briefing, delivered Tuesday to senior staff at the agency’s headquarters in Washington by newly appointed Border Patrol Chief Mike Banks, instructs U.S. agents to use an extraordinary emergency authority to close the border. The only two Border Patrol officials who can authorize the release of an asylum seeker into the United States with a pending humanitarian claim are Banks and his deputy.

The briefing document is an early glimpse into the real-world application of the fusillade of executive orders Trump issued Monday, and their translation into field guidance for the Border Patrol’s 19,000 agents. The White House did not immediately respond to a request for comment.

During the coronavirus pandemic, the Trump administration used an emergency public health law to close off asylum access at U.S. borders. This time, Trump officials have not cited a specific disease, instead invoking emergency authorities with the argument that migrants could be carrying any transmissible illness.

That is a deliberate distraction from the main issue.

The Refugee/Asylum Treaty signed by the USA requires all refugees to apply for Asylum in the very first country they enter after leaving their own country.

Almost none of the millions of Asylum seekers in the USA have arrived directly from their home country.

The USA - and Trump - would be completely within their rights to send these folks straight back to the first country they entered - or - charge them with Asylum Fraud.

Trump, unfortunately, is never going to do that.

Sorry, that is incorrect - only citizens of Belize and Guatemala have "First Foot" Asylum rights in Mexico.

99% of the Asylum Seekers the USA sends to Mexico have NO Asylum rights in Mexico.

The USA is paying Mexico 100% of their housing, food, and medical costs, and probably a custodial fee to the Mexican government.

In addition, the USA-Canada-Mexico have their own regional Asylum Agreement.

If a citizen of Mexico or Canada requests Asylum, they go straight to the front of the line for an Asylum Hearing.

Their case will be in front of a USA Asylum judge in days.

If they lie, they can be charged with perjury and fraud and sent to jail within weeks.

99% of Asylum claims from Mexican and Canadian citizens are rejected within a couple weeks, and that person is immediately sent back.
