TikTok, the video-sharing platform owned by Chinese company ByteDance, is on the verge of being shut down in the United States unless it can find a new owner. American lawmakers argue its current proprietorship poses a national security threat.
It comes after outgoing president Joe Biden signed legislation into law last April that would require the company to sell TikTok by January 19, 2025.
On Friday, representatives for ByteDance will plead to the US Supreme Court to try and halt the decision. They are expected to frame the ban as un-American and an attack on the First Amendment, which defends freedom of expression.
The Supreme Court will then review the arguments and come to a final decision the following week.

How is this even a 1st Amendment case?
This is a Chinese company operating in the US at the sole discretion of the US government...they have no 1st Amendment rights.
TIKTOK is nothing more than a vehicle to spy on Americans and shouldn’t be here in the first place. Thinking they come under the jurisdiction of our Courts is ludicrous.

Because the bill is not just aimed at only TikTok. Te bill casts a huge net that can be used against any and every server host and/or domain on the U.S and global internet including the Free Republic.
That is why it is a 1st amendment case...

TikTok is probably running on either Android or Iphone software.
The TikTok app would be downloaded from an app store. I know of two. The TikTok software source code could be reviewed by a trusted US company, compiled, and placed on the app stores.

So you want the US government to emulate China’s communistic oppression of free speech then? Eye for an eye even if it means universal collateral damage? Because they do it we should do it too?
If so then what will set us apart and make us unique and NOT China? Why should we purposely step on our own feet like that?

They can’t legislate from the bench for every issue.
I think it will be 8-1 or 9-0 on a narrowly crafted opinion that holds TikTok is a national security risk because of the belief that the Chinese government can have access to the data and that China is considered essentially an adversary per the approved legislation.
Re: 13 - the First Amendment does not extend to foreign corporations.
