The Penny verdict reveals how New York City failed Jordan Neely

In May 2023, a homeless man named Jordan Neely entered a New York City subway car, where he began acting erratically, scaring the other passengers by saying things such as: “I don’t care if I die. I don’t care if you die. Lock me up for life.” Neely did die, after Daniel Penny, an architecture student and Marine veteran, restrained him in a choke hold. Mr. Penny was prosecuted for manslaughter and criminally negligent homicide. On Monday, a jury found him not guilty of criminally negligent homicide and deadlocked on second-degree manslaughter.

The verdict, like the case, has been divisive. “You can’t do this to American heroes,” said Rep. Chip Roy (R-Texas), urging the Justice Department to “hold New York accountable” for trying Mr. Penny in the first place. Meanwhile, the New York City Council’s Black, Latino and Asian Caucus called Mr. Penny’s actions “vigilante justice” and blamed the gaps in the city’s social safety net.

The council members are correct that New York failed Neely, who suffered from a lifetime of trauma compounded by substance abuse and severe mental illness. But the problem wasn’t simply a lack of resources; one could not make Neely use those resources, and he was too badly impaired to realize he needed them.

Neely had a number of prior hospitalizations and a long list of arrests for crimes including indecent exposure and assault, along with lower-level offenses. Reportedly, he was on a list of the city’s 50 most at-risk homeless individuals. Yet Neely remained in crisis, and in 2021 he assaulted two elderly women. The justice system failed everyone else by not making sure Neely wasn’t a threat.
Instead, it let him free to rampage and assault people.
This cost him his life.
So the entities most responsible for his death, the idiot prosecutors and judges that kept unleashing him into the population.

Daniel Penny is the Bernie Goetz of the 2020s. At least he only had one Dude of Diversity to deal with instead of four of them.

He could of been found guilty-that’s the problem. We need a board of citizens to decide whether or not the prosecution should go ahead-no lawyers. I would like to be on that board with those 2 black race grifters arguing it should go ahead.

The guy’s a hero. We need men to step forward. The jig is up.

A bit of an understatement. I doubt NYC subway riders are scared by run of the mill seen it before typical loony NYC erratic behavior by a homeless passenger. They were not “scared” like they were watching a scary movie. They were in fear for their personal safety and lives. Such fear was reasonable and they had a right to defend themselves and others under the same threat.

Penny did the right thing. Considering Neely’s mental status and life style I doubt he had a long life ahead of him. Any chance of one was erased not only by his own choices but by the lack of resources to get him the treatment he needed.

The NEELY’s of the country need to be inside mental facilities. OF the PARENTS were NOT AWARE of his mental condition-—they were NOT paying attention.
