Hunter Biden argues his conviction should be tossed, citing judge's ruling in Trump documents case

Hunter Biden is using a pair of judicial opinions that were favorable to his father's political rival to argue his conviction on gun charges should be tossed out.

In federal court papers filed in Delaware, Hunter Biden’s attorneys asked the judge who oversaw his gun trial to dismiss the case against him because of a federal court ruling in Florida dismissing the classified documents case against former President Donald Trump.

In the ruling Monday, U.S. District Judge Aileen Cannon dismissed Jack Smith’s criminal case against Trump on the grounds that the appointment of and funding for the special counsel were illegal.

President Joe Biden’s son contends that that ruling, plus a concurrence by Justice Clarence Thomas in the Supreme Court’s presidential immunity decision in the federal election interference case against Trump earlier this month, are reasons to dismiss special counsel David Weiss’ case against him.

“Based on these new legal developments, Mr. Biden moves to dismiss the indictment brought against him because the Special Counsel who initiated this prosecution was appointed in violation of the Appointments Clause as well,” the filing says.

“The Attorney General relied upon the exact same authority to appoint the Special Counsel in both the Trump and Biden matters, and both appointments are invalid for the same reason,” the filing argues.

Strange. Trump’s case was dismissed because the prosecutor was ineligible to run the prosecution. What does that have to do with Biden’s case? The Dems sure like to play fast and loose!

Wait. Biden was prosecuted by a Special Counsel? Why? What’s wrong with a regular prosecutor? Did they think they would get favorable treatment from someone they appointed? Why appoint a SP for just a gun charge?

Big difference, David Weiss was a senate confirmed US Attorney. Jack Smith was a private citizen. Hur and Durham were also senate confirmed.

True. There might be a slight chance because he wasn't confirmed as a special counsel but it is a Hail Mary.

Seems like just trying to muddy the waters. Baseless, silly claim, but if you say it loud enough, some people will jump to the conclusion that “The Establishment” loves Trump and always treats him well, while the poor Biden family is endlessly persecuted by hateful Nazis.

That's the argument presented by Ed Meese in his brief with the Supreme Court. But it looks like justice Thomas doesn't agree. If you look at his concurring opinion, on the first page he writes:

But, I am not sure that any office for the Special Counsel has been “established by Law,” as the Constitution requires.

That covers who did the prosecutions, but what about the people being prosecuted? What position does Hunter Biden hold in the government, much less the Biden administration?

None.

The Jack Smith vs Trump ruling has no relation to Hunter Biden’s prosecution.

Weiss is the US Attorney for the District of Delaware. He can prosecute either in Delaware, or with permission, any other District in the entire country. That was what that circus with him not getting permission to file charges in California was about. There’s a procedure for that. No Special Counsel-hood needed.

I’m not sure it is even that. It might just be to enable a *political* argument by making the (false) comparison to Trump’s cases.
